Legal news in Ukraine: Constitutional Court will review the dissolution of parliament on June 11, decision of the CCU on pensions for years of service, Rada passed the law on the impeachment and citizenship for foreign volunteers

The Constitutional Court will consider the dissolution of the Council on June 11

The Grand Chamber of the Constitutional Court of Ukraine will consider the case on the constitutionality of the Presidential Decree "On early termination of powers of the Verkhovna Rada of Ukraine and the appointment of early elections" in the form of oral proceedings,s informed the Department of Communications of the KSU and legal monitoring.

In addition, in accordance with Article 75 of the Law of Ukraine "On the Constitutional Court of Ukraine", the Grand Chamber of the Constitutional Court recognized the constitutional proceeding of this case as urgent.

The open part of the plenary meeting in this case will be held on June 11, 2019 at 10 o'clock.

It should be noted that 62 deputies of Ukraine appealed to the Constitutional Court regarding the constitutionality of the Decree of the President of Ukraine on dissolution of the Parliament.

The head of the Verkhovna Rada Andriy Parubiy, and lawyer-experts also called this decree unconstitutional.

On May 23, 2019, the «Uryadovy Kuryer» issued a decree of the President of Ukraine Volodymyr Zelenskyy on the pre-term termination of the powers of the Verkhovna Rada of Ukraine of the eighth convocation and the appointment of early elections on July 21.

Let’s add that, in accordance with Article 83 (7) of the Constitution of Ukraine, within one month from the date of termination of the coalition's activities, a new one must be formed. Otherwise, the parliament may be dissolved by the President.

At the same time, Article 90 of the Constitution of Ukraine provides that the powers of the Verkhovna Rada of Ukraine can not be terminated by the President of Ukraine in the last six months of the term of office of the Verkhovna Rada of Ukraine or the President of Ukraine.

The Constitutional Court ruled on a retirement pension for years of service

On June 4, 2019, the Constitutional Court of Ukraine found unconstitutional provisions of item «a» of Article 54 and Article 55 of the Law of Ukraine «On Pension Provision» of November 5, 1991, No. 1788-XII, as amended, informed the Communications Department of the Constitutional Court of Ukraine and legal monitoring.

Amendments introduced by the laws of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on Pensions» of March 2, 2015, No. 213-VIII, «On Amendments to Certain Legislative Acts of Ukraine», dated December 24, 2015, No. 911-VIII.

The Constitutional Court of Ukraine notes that changes in the provision of pensions should be sufficiently substantiated, carried out gradually, carefully and in a prudent way, based on objective criteria, be proportional to the objective of changing legal regulation, to ensure a fair balance between the general interests of society and the obligation «to protect human rights without violating the right to social protection».

Law No. 911 states that in order to receive the pension for years of service flight and flight test personnel must reach 50 years and education, health and social workers, as well as theatrical performers -concert and other entertainment establishments, enterprises and collectives – 55 years.

In accordance with Article 51 of Law No. 1788, long-service pensions are established for certain categories of citizens employed in work, the fulfillment of which leads to loss of professional working ability or fitness before the age of eligibility for an old-age pension.

That is, in this norm we are talking about jobs that have a direct impact on the health of the employee and can lead to loss of professional working ability (ability to perform work in the profession) until the age that gives the right to an old-age pension and, consequently, to the inability to effectively perform work without prejudice to their own health and the safety of others.

"It follows from the above that the loss of professional working ability or fitness is not related to the employee’s attaining a certain age, therefore it cannot be a condition for a pension for years of service,” the report says.

The Constitutional Court of Ukraine proceeds from the fact that the establishment of an additional condition for the appointment of such a pension negates the essence of the right to social protection, does not comply with the constitutional principles of the welfare state and contradicts the provisions of Articles 1, 3, part three of Article 22, Article 46 of the Basic Law of Ukraine.

Amendments to the Law No. 213 to the disputed provisions of Law No. 1788 concerning the increase of five years of retirement age for women and the increase of five years of general and special work experience for the appointment of a pension for years of service were carried out without regard to the legal nature of the appointment of such a pension.

The decision of the Constitutional Court of Ukraine is binding, final, and that can not be appealed.

Parliament passed the Law on Temporary Investigation Commissions with the rule of impeachment

The Verkhovna Rada adopted the Law of Ukraine “On Temporary Investigation Commissions and Temporary Special Commissions of the Verkhovna Rada of Ukraine”.

The law determines the legal status of the temporary investigative commissions, the special temporary investigative commission and temporary special commissions of the Verkhovna Rada of Ukraine, their powers and organizational bases of activity.

The legislative act establishes the status of temporary investigative commissions, a special temporary investigatory commission and temporary special commissions of the Verkhovna Rada of Ukraine.

According to the Law, “the temporary investigative commission of the Verkhovna Rada of Ukraine is a collegial temporary body of the Verkhovna Rada of Ukraine, which is formed from the number of people's deputies of Ukraine, whose task is to exercise parliamentary control by conducting investigations on matters of public interest.

The grounds for the formation of a commission of inquiry can be reports of violations of the Constitution of Ukraine, the laws of Ukraine by government bodies, local governments, their officials, officers, leaders (or officials acting on their duties) enterprises, institutions, organizations regardless of ownership, public associations of public interest.

A special temporary investigative commission of the Verkhovna Rada of Ukraine is formed by the people's deputies of Ukraine, a special prosecutor and special investigators. The commission’s task is to investigate the circumstances of the treason or other crime committed by the President of Ukraine, set forth in the submission of deputies concerning the impeachment of the President of Ukraine.

Submissions must be signed by a majority of deputies from the constitutional composition of the parliament. The resignation of the president should be supported by three quarters of the deputies.

The law establishes that the organization and operation of the commissions are determined, in particular, by the Constitution of Ukraine and the Regulations of the Verkhovna Rada of Ukraine.

The law establishes that the investigative commission submits a written progress report to the Verkhovna Rada of Ukraine within six months.

The term of office of the investigative commission and the special commission may not exceed one year from the date of their creation.

Ukraine has simplified the procedure for obtaining citizenship for foreign volunteers

The Verkhovna Rada adopted the Law of Ukraine «On Amendments to Certain Legislative Act» (regarding the legal status of foreigners and stateless persons who participated in the defense of Ukraine’s territorial integrity and immunity».

The law amended the Laws of Ukraine «On the legal status of foreigners and stateless persons» and «On the citizenship of Ukraine»».

In particular, the amendments to the Law «On the legal status of foreigners and stateless persons» defined the term «participation in the defense of the territorial integrity and inviolability of Ukraine» regarding foreigners and stateless persons, provided practical assistance to units involved in the antiterrorist operation.

The law also recognizes foreigners and stateless persons who participated in the defense of Ukraine’s territorial integrity legally in Ukraine and gives the opportunity for such persons to obtain a residence permit in Ukraine for the duration of their participation in the defense of Ukraine’s territorial integrity and immunity.

The law establishes restrictions on the voluntary or forced return of such foreigners and stateless persons to the aggressor state or countries, that does not recognize the territorial integrity of Ukraine, or supports aggression against Ukraine.

The law also simplifies the procedure for obtaining citizenship of Ukraine by foreigners and stateless persons who have provided practical assistance in protecting the territorial integrity and inviolability of Ukraine.
