The Verkhovna Rada of the eighth convocation held its last plenary meeting

On July 12, 2019, the Verkhovna Rada of Ukraine of the eighth convocation held its last plenary meeting.

According to the Speaker of the Parliament Andriy Parubiy, during its term of office, the Council held 580 plenary meetings and 35 parliamentary hearings, approved 2734 legislative acts, including 987 laws and codes in general.

Parubiy recalled the Council’s most important achievements, in particular the adoption of the language law, the Anti-Corruption Court Law, the Law on Decommissioning, the Election Code, pension, medical, anti-corruption reforms and the reform of the police and local self-government.

The last plenary session of the Council took place in an almost empty hall. On July 15-19, people’s deputies will work in committees, commissions and factions.

So July 19, 2019 is the last day of the work of the Council of the eighth convocation.

On July 21, 2019, extraordinary elections to the Ukrainian parliament will take place.

Verkhovna Rada adopted the Electoral Code with open lists

July 11, 2019 Verkhovna Rada adopted the Electoral Code of Ukraine. People's Deputies voted 17 times for the document.

We note, according to the Electoral Code, the elections of people’s deputies of Ukraine are held on the basis of a proportional system according to the electoral lists of candidates from political parties.

The mandates of the deputies will be distributed among the electoral lists of candidates, which, according to the results of the vote in the parliamentary elections, gained 5 percent.

A system with open lists of candidates will be applied during the elections. It will allows personalization of voting.

A similar electoral system will also be applied to elections of deputies of the Verkhovna Rada of the Autonomous Republic of Crimea, regional councils, as well as city councils of those cities where the number of voters exceeds 90 thousand people. These cities include all regional centers, as well as several other cities of regional significance.

At the elections of city mayors of such cities an electoral system of absolute majority will be applied.

Elections of deputies of the village, settlement council, city council (cities with the number of voters to 90 thousand people), district councils in the city are held in the system of relative majority in multi-mandate constituencies.

At least two and not more than four deputies may be elected in each district.

At the same time, elections of deputies of the district council are carried out according to the system of the relative majority in multi-mandate constituencies, the borders of which coincide with the boundaries of villages, settlements (communities), cities that are part of the respective district. At least two and not more than four deputies may be elected in each district.

The electoral code will come into force on December 1, 2023.

People’s Deputies approved the law on the registry of pedophiles and their forced castration

The Verkhovna Rada adopted the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine regarding increased liability for crimes committed against a minor and a person who has not reached puberty».

Deputies introduced amendments to Article 152 of the Criminal Code and increased responsibility for rape and rape of minors - up to fifteen years of imprisonment with the use of forced chemical castration.

The Criminal Code added a new article 59-1 introducing a new form of punishment – forced chemical castration. Convicts will be involuntarily injected with antiandrogenic drugs consisting of chemicals for reducing libido and sexual activity.

The Rada has introduced administrative supervision of adult persons convicted of rape and maltreatment of minors, which is established on a life-long basis.

Also, the Cabinet of Ministers of Ukraine should ensure the establishment of a public register of children abusers.

The president presented a bill on a new wave of lustration

The President of Ukraine introduced to the Verkhovna Rada a draft Law No. 10444 «On Amending Certain Legislative Acts of Ukraine Regarding the Purge of Power».

The project introduces a number of changes to the Law of Ukraine «On the Purge of Power», as well as to the laws of Ukraine «On Elections of People’s Deputies of Ukraine», «On Elections of the President of Ukraine», «On Local Elections», «On Advocacy and Advocacy».

The President offers to lustrate persons who occupied the posts of President of Ukraine, Chairman of the Verkhovna Rada, Prosecutor General, Chairman of the SBU, heads of the Antimonopoly Committee and the State Property Fund, chairmen of the State Fiscal Service and Customs, Secretary of the National Security and Defense Council , leaders of defense enterprises from February 23, 2014 to May 19, 2019.

It is also proposed to lustrate the members of the High Council of Justice, members of the High Qualification Commission of Judges of Ukraine, judges, the Chairman of the State Judicial Administration of Ukraine, and his deputy.

The document proposes to extend lustration to people's deputies of Ukraine and government members of this period.

It should be noted that the provisions of the draft law repeat those provisions of the current Law of Ukraine "On the purification of power", the question of the constitutionality of which is considered by the Constitutional Court of Ukraine.

On May 14, 2019, the Constitutional Court of Ukraine deferred the continuation of consideration of the case on the constitutionality of a number of norms of the Law of Ukraine «On the Purge of Power».

In particular, the Supreme Court requests to verify the constitutionality of paragraph 6 of the first part, points 2, 13 of the second part, and part three of Article 3 of the Law, and deputies - parts three, six, Article 1, paragraphs 1, 2, 3, 4, 8, Article 8, paragraph 2 part five of article 5, paragraph 2 of the Final and Transitional Provisions.

High Anti-Corruption Court of Ukraine has received new premises

The High Anti-Corruption Court of Ukraine and the Regional department of the State Property Fund of Ukraine in Kyiv signed an agreement on a new premises for the court.

The address of the new court’s building – prosp. Peremogy, 41, Kyiv.

Now the court is housed in temporary premises, the area of ​​which is not enough for the work of judges.

Anti-Corruption Court will begin work on September 5, 2019.

On July 8, President of Ukraine Vladimir Zelenskyy submitted to the Verkhovna Rada a draft Law No. 10426 «On Amendments to the Law of Ukraine» regarding the High Anti-Corruption Court» (on the start of the court’s work).

The proposed amendments clarify the jurisdiction of the court. The court will focus on criminal trials that are included in the Unified Register of Pre-Trial Investigations, if the pre-trial investigation was carried out or is carried out by NABU detectives and completed by Specialized Anti-Corruption Prosecutor’s Office’s prosecutors.
