Legal news in Ukraine: Congress of Advocates was held, Register of Free Legal Aid’ advocates was expanded, Constitutional Court will consider new cases, trainings for lawyers, Parliamentary Reform Office will work, bill on the debt write-off for utilities

The Congress of Advocates of Ukraine was held in the Lviv region

The Congress of Advocates of Ukraine took place in the Lviv region on February 15-16.

The event was attended by 181 delegates.

The congress, among other things, called on the Verkhovna Rada to return the bill «On Advocacy and Advocacy» № 9055 to the subject of legislative initiative.

Attorneys insist that the adoption of the bill as a basis and in general will make it impossible for lawyers to protect the rights, freedoms and interests of persons, and to be independent from political will.

Attorneys also have made comments on the key issues of the bill and amendments to the Criminal Procedure Code contained in the transitional provisions.

In addition, the Congress elected Alexander Drozdov as a member of the High Qualification Commission of Judges of Ukraine, and Pavlo Grechkivsky and Oleksiy Malovatsky as members of the High Council of Justice.

The register of lawyers providing free secondary legal aid has been expanded

430 lawyers are included in the Register of Attorneys who provide free secondary legal aid, states the Coordination Center for the provision of free legal aid’s website.

«The selection of lawyers is as simple as possible. The contestants had to show their readiness to carry out a social mission, which is to provide legal assistance to the most vulnerable segments of the population. In addition, they had to prove that they understood the functioning of the free legal aid system», – said Director of the Coordination Center for Legal Assistance Oleksiy Bonyuk.

Lawyers registered online to participate in the contest. They also took the distance course «Introduction to Free Legal Assistance Systems». Course evaluation was done automatically.

The Constitutional Court will consider the case of renaming the Dnipropetrovsk region

The Constitutional Court of Ukraine received a constitutional appeal from the Verkhovna Rada of Ukraine to rename the Dnipropetrovsk region, the communications department of the Constitutional Court and legal monitoring reported.

«On February 14, the Constitutional Court of Ukraine received a constitutional appeal by the Verkhovna Rada of Ukraine on the provision of an opinion on compliance with the Constitution of draft law № 9310-1 on amending Article 133 of the Constitution of Ukraine (regarding the renaming of the Dnipropetrovsk region)», the statement reads.

The bill proposes to rename the Dnipropetrovsk region in Sicheslav region.

The document will be checked for compliance with the requirements of Articles 157 and 158 of the Constitution of Ukraine.

It is worth reminding, the Constitutional Court of Ukraine earlier gave a positive opinion on the case of renaming the Kirovograd region to the Kropivnitsk region.

The Constitutional Court will interpret the rule of appointing members of the High Council for Justice

The Constitutional Court of Ukraine received a constitutional petition from 48 people’s deputies regarding the official interpretation of the provisions of part 5 of Article 131 of the Constitution of Ukraine.

This norm establishes that one and the same person can not hold the position of a member of the High Council of Justice for two consecutive terms.

The submission states that the High Council of Justice is the successor to the High Council of Justice (ІІ), therefore the relevant requirements apply to former members of the High Council of Justice (II) who have become members of the HCJ.

According to the law, persons who were members of the HCJ (ІІ) and have become members of the HCJ, have the right to submit documents for election as a member of the HCJ. But they must not be admitted (as a result of a special check) to participate in the competition, as those which do not meet the requirements established by law.

At the same time, such persons were included in the list of candidates for the position of a member of the High Council of Justice for the election by the Congress of Advocates of Ukraine.

«Gross violation of the Constitution of Ukraine and neglect of the Ukrainian legislation led to the need for an official interpretation of the provisions of part five of Article 131 of the Constitution of Ukraine», the statement reads.

Therefore, deputies ask to explain whether a person who was a member of the High Council of Justice (II) and acquired the status of the HCJ, can be re-elected as a member of the HCJ.

The Parliamentary Reform Office will work in Ukraine

The Parliamentary Reform Office will work in Ukraine in a month, announced the Chairman of the Verkhovna Rada, Andrei Parubiy.

One of the main tasks of the office will be to support the legislative process and parliamentary control over it. The office will provide an analysis of government and deputy legislative initiatives.

It is planned to attract 15 employees to work in the Office in accordance with the directions of parliamentary work.

«I am sure that the creation of the Parliamentary Reform Office will help us in more detail to accompany the legislative preparation of the laws necessary for the Association Agreement with the European Union», said Parubiy.

The Ukrainian National Bar Association approved the plan of trainings for lawyers in 2019

The Committee for the Advancement of Professional Qualifications of the Ukrainian National Bar Association has approved the plan of measures for the professional development of lawyers in 2019.

Among other events, a training seminar is planned for February 23, 2019 in Kiev. Starting from March, trainings should be held in the regions.

In March 2019, within the framework of a joint project with the Council of Europe, training will be conducted for trainers in assisting victims of domestic violence and violence against women under the Istanbul Convention. Coaches will continue to be involved in conducting training for lawyers throughout Ukraine.

It is also planned to conduct trainings on specialized courses of the European program for training representatives of legal professions in the field of human rights HELP: «Bioethics», «Eligibility Criteria», «Labor Rights under the Convention for the Protection of Human Rights and Fundamental Freedoms» and «Maltreatment».

The bill on the debt write-off for utilities was registered in the Parliament

The Verkhovna Rada registered the draft Law of Ukraine № 9527-1 «On the debt write-off of household customers for the supply of natural gas, electric energy, district heating and hot water supply services, which was formed as of January 1, 2019».

The purpose of the bill is to protect the population of Ukraine from the rapid growth of prices and tariffs for public utilities for household consumers in 2015-2018, which does not correspond to real incomes and solvency of Ukrainians. Significant tariff increase is antisocial and leads to the inability of the population to pay them for objective reasons.

It is proposed to write off the generated debt of household consumers (as of January 1, 2019) for the supply of: natural gas, electric energy, services of centralized heating and hot water supply.
