The Constitutional Court will begin consideration of the case on the dissolution of the Rada on June 4

On June 4, 2019, the Constitutional Court of Ukraine will begin consideration of the case on the constitutionality of the Decree of the President of Ukraine Volodymyr Zelenskyy "On the early termination of the powers of the Verkhovna Rada of Ukraine and the appointment of early elections".

As stated in the CCU agenda, the Court will determine the form of constitutional proceedings in this case.

It should be noted, that 62 people's deputies of Ukraine appealed to the Constitutional Court regarding the constitutionality of the Decree of the President of Ukraine on the dissolution of parliament

This decree is also called unconstitutional by the Chairman of the Verkhovna Rada Andriy Parubiy, and legal experts. According to the capital's media, most of the CCU’s judges adhere to this version.

Let’s recall that on May 23, 2019, the «Government Courier» published the Decree of the President of Ukraine Volodymyr Zelenskyy on the early termination of the powers of the Verkhovna Rada of Ukraine of the eighth convocation and the appointment of early elections on July 21. The president explains his decision by the fact that in the parliament since 2016 there is virtually no coalition.

Prime Minister of Ukraine remains in office

The Verkhovna Rada has not supported the resignation of the Prime Minister of Ukraine Volodymyr Groysman.

Only 97 deputies voted for the resignation, 63 elects voted against, and another 50 abstained.

The head of government submitted a resignation to the Verkhovna Rada on May 22.

It should be noted, the Prime Minister of Ukraine has the right to declare to the Verkhovna Rada of Ukraine about his resignation. His resignation entails the resignation of the entire Cabinet of Ministers of Ukraine. In these cases, the Verkhovna Rada of Ukraine forms a new government.

The bill on the impeachment of the president was introduced to parliament

On May 29, 2019, draft Law No. 10340 «On a special procedure for removing the President of Ukraine from the post (impeachment)» was registered in Verkhovna Rada».

The bill was introduced by President of Ukraine Volodymyr Zelenskyy.

The draft stipulates that the procedure for impeachment will be initiated by a majority of people's deputies of Ukraine from the constitutional composition of the Verkhovna Rada of Ukraine.

The Special Temporary Investigation Commission will prepare conclusions and proposals for the commission of a state treason or other crime by the President of Ukraine. It will consist of people's deputies of Ukraine (taking into account the principle of proportional representation of deputy factions and groups), a special prosecutor and special investigators.

The defense of the rights, freedoms and legitimate interests of the head of state in the procedure of impeachment will be ensured by the defenders of the President of Ukraine.

The plenary session of the Verkhovna Rada of Ukraine on the consideration of the Commission’s conclusions will be open (except in cases where the findings will contain secret information).

After the Verkhovna Rada of Ukraine adopts a decision on the accusation of the President of Ukraine, the Verkhovna Rada of Ukraine will appeal to the Constitutional Court of Ukraine (to obtain a conclusion on the observance of the constitutional procedure for investigation and consideration of the case on removal of the President of Ukraine from office in the procedure of impeachment) and the Supreme Court (to obtain a conclusion, that the acts, in which the President of Ukraine is accused, contain signs of state betrayal or other crime).

The decision to remove the President of Ukraine from office in the order of impeachment will be taken only if the conclusions of the Constitutional Court of Ukraine and the Supreme Court will testify to the observance of the Constitution’s and laws of Ukraine’ requirements.

The decision on impeachment will be considered adopted if at least three-quarters of the people’s deputies of Ukraine from the constitutional composition of the Verkhovna Rada of Ukraine vote for it.

Interestingly, President Zelenskyy proposes that if the Verkhovna Rada does not adopt the impeachment ruling, the chairman, on behalf of the parliament, apologizes to the President of Ukraine.

Prisoners rioted in the South Penitentiary

On May 27, a rebellion of prisoners occurred in the Southern Penitentiary colony No. 51 for men (Odessa). There was a fire during the rebellion in the utility room.

The rebels took hostage three medical workers and three guards who were in local areas of the colony. At the same time, 13 employees of correctional colonies No. 51 and No. 14, that were involved in normalizing the situation, were injured. Three of them were hospitalized.

There are no casualties as a result of the accident.

The prisoners later posted a video of the riot on the Internet. In one of the videos, they accuse law enforcement officers of ill-treatment and talk about the terrible conditions in the colony.

In response, Deputy Minister of Justice Denis Chernyshev noted that the conditions are really imperfect, but the agency is «making titanic efforts» to increase the financing of the system. According to him, the rebels destroyed the bath and the store.

Alexander Malakhov, head of the Southern Interregional Office for the Execution of Criminal Sentences and Probation of the Ministry of Justice, confirmed that the riots in the colony began after the decision to transfer several convicted «authorities» to other correctional institutions.

Malakhov added that the colony itself will be closed "for conservation". Some structures were damaged by fire and are now unsuitable for use.

The convicts will be transferred to other institutions in the coming months.
