Extraordinary elections to the Ukrainian parliament took place

Extraordinary elections of people’s deputies of Ukraine took place. There were no events that would have called into question their conduct, the head of the Central Election Commission Tetyana Slipachuk stated at a briefing.

«There were no such events that would have called into question the holding of this parliamentary campaign», said Slipachuk and stressed that «parliamentary elections have taken place».

The turnout of voters in the elections that took place on July 21 stood at 49.84%.

On July 26, the Central Election Commission reported that it had processed 100% of the electronic protocols on the results of voting in the multi-mandate constituency.

According to these results, 43.16% of voters voted for the «Servant of the people» party, 13.05% – «Opposition platform – For life», 8.15% – All-Ukrainian Union «Fatherland», 8.10% – «European solidarity» and Ukrainian political party «Voice» – 5.82%.

The CEC must determine the results of the election no later than 15 days from the day of voting, that is, until 5 August.

Within 5 days after the results are established, they must officially announce the results of the elections in the «Voice of Ukraine» (Holos Ukrayiny) and in the «Governmental Courier» (Uryadovy Courier).

Also, within 5 days from the date of publication, a preparatory deputy group is formed, which terminates the work after the establishment of Verkhovna Rada’s Committees. The group is preparing proposals for organizing and holding plenary sessions of the new convocation council’s first session.

The Verkhovna Rada of the new convocation meets for the first session and the deputies take the oath at the solemn meeting before the first session no later than 30 days after the results are announced.

The Prosecutor General's Office has prepared suspicions for judges of the District Administrative Court of Kyiv

On July 26, 2019, NABU detectives together with investigators of the Office of Special Investigations of the Prosecutor General's Office of Ukraine searched the premises of the District Administrative Court of Kyiv and the Suvorovsky District Court of Odessa.

The search was conducted as part of an investigation into the possible commission of criminal offenses by the head and individual judges of the Kiev court.

The investigation thinks that judges have organized deliberately unlawful court decisions and intervened in the activity of judicial bodies in order to create artificial obstacles in the work of the High Qualification Commission of Judges of Ukraine. The purpose of these actions is to avoid compulsory qualification assessment established by law for judges.

Their plan, according to the investigation, they realized in several stages.

The judges allegedly artificially initiated the filing of lawsuits for the lack of authority of some members of the HQCJU. Claims have banned them from fulfilling their powers. The judges ensured that these decisions were taken in their favor.

In addition, the chairman of the court provided for the replacement of two members of the Commission to loyal members, who were elected by the quota of the Ombudsman and the State Judicial Administration.

Also NABU announced on its website records of allegedly mentioned above judges of the District Administrative Court of Kiev’ conversations.

In conversations, in particular, they are allegedly discussing how to change the composition of the HQCJU to ensure that it is possible to avoid qualifying assessment.

Bodies for the selection of judges can be reorganized in Ukraine

The Center for Political and Legal Reforms has developed a draft law «On the Fundamentals of the State Anti-Corruption Policy in Ukraine (Anti-Corruption Strategy) for 2019-2023».

One of the sections of the project is devoted to the prevention of corruption in the sphere of justice and internal affairs and has 27 events.

The project proposes to make primarily changes to the laws of Ukraine «On the judicial system and the status of judges» and «On the High Council of Justice».

It is proposed to reorganize the bodies for the selection of judges and bring them to disciplinary responsibility and create Qualification and Disciplinary Commissions of judges.

Half of them will be selected by high-ranking public associations and the other – by judges via an electronic voting system.

The integrity of candidates for members of the Qualification and Disciplinary Commissions of Judges, the High Council for Justice, the current members of the High Council for Justice is audited by the Public Council of International Experts.

It is also proposed to introduce monitoring of adherence to judicial duties, to improve the procedure for qualification assessment of judges and to reconsider the decision of the previous composition of the High Qualification Commission of Judges, adopted in the presence of a separate opinion of a member of the commission or a negative opinion of the Public Council of Integrity, or in the case of a judge’s assessment without the participation of the GRD.

The president of Ukraine signed an antiraid decree

On July 22, 2019, president of Ukraine Volodymyr Zelenskyy signed the Decree No. 542/2019 «On measures to counteract raiding».

The decree, among other things, provides for the development and adoption in the near future of a bill aimed at strengthening the guarantees of state protection of real rights to real estate and their encumbrances, protection of the rights of founders (participants) of legal entities and counteraction to raiding.

This is, among other things, the revision of the structure of the State Register of Real Property Rights to Real Estate, the Unified State Register of Legal Entities, individuals - entrepreneurs and public formations.

It is proposed to introduce the possibility of implementing separate registration actions on the electronic services portal of legal entities, individuals - entrepreneurs and public formations automatically without the participation of the state registrar, as well as creating a single electronic register of notarial actions.

Also among the proposals: the exclusion of accredited subjects from among the subjects exercising authority in the field of state registration of rights and implementation of registration actions exclusively by a notary who performed the corresponding notarial act, on the principle of simultaneity.

A government order on the Ukrainian Law Week in 2019 has been published

The order of the Cabinet of Ministers of Ukraine of July 24, 2019 No. 568-p about the All-Ukrainian Law Week in 2019 was published.

This year such events are planned:

All-Ukrainian lesson «Human Rights» on the occasion of the proclamation of the Universal Declaration of Human Rights in schools, as well as educational lessons;

lectures, scientific and practical seminars, round tables, excursions, workshops, legal competitions, games, competitions in educational and cultural institutions, military units on the subject of the implementation and protection of human rights;

art exhibitions, in particular photo exhibitions, a meeting of book clubs, presentations of publications on human rights and other literature of legal content;

International Law Competition named after Volodymyr Koretskyy;

«Open Days» in the executive authorities with the invitation of school-age children.

In Ukraine every year in December, starting from 2008, the All-Ukrainian Week of Law is held on the occasion of the anniversary of the Universal Declaration of Human Rights’s adoption.
