Legal news in Ukraine: new courts began to work, the contest to the IP-court continues, the Law on the language passed the first reading, Parliament has continued the special status of the Donbas, the procedure of offenders extradition has been simplified

New appellate courts have begun work in Ukraine

The first 26 newly created appellate courts, established within the framework of the reorganization, started their work.

These are: Dniprovsky, Volyn, Kherson, Zhytomyr, Lugansk, Chernigov, Khmelnytsky, Mykolayiv, Ivano-Frankivsk, Zakarpattia, Kharkiv, Rivne, Kiev, Ternopil and Donetsk courts.

Also, the First, Third, Fifth, Sixth, Seventh and Eighth Appeal Administrative Courts, as well as the Western, Central, North, Southwest and Eastern Economic Court of Appeals, have commenced work.

The Lviv Court of Appeals announced the commencement of work on October 4.

In addition, the State Judicial Administration of Ukraine approved the Classifier of Courts, which introduced a new format of court codes.

The court code will now contain the letters and numeric characters, which in the future, with the introduction of the Unified Judicial Information and Telecommunication System, will allow you to generate a unique court case number and a judicial decision number based on the rules of the European Case Low Identifier.

It should be reminded, 350 appellate and district courts were formed by the Decrees of the President of Ukraine of December 29, 2017. The 27 district administrative courts, established by the Presidential Decree of November 16, 2004 No. 1417/2004, continue to administer justice.

Applicants to the IP court have written a qualification exam

21 candidates for a judge’s position in the Supreme Intellectual Property Court have written a qualification examination.

The High Qualifications Commission of Judges of Ukraine allowed 210 people to join the competition, including judges, patent attorneys and lawyers. The exam was attended by 148 people.

The candidates wrote anonymous tests and performed a practical assignment. The contestants responded to 120 test questions, testing lasted 2.5 hours. The practical task was fulfilled for five and a half hours. The participants of the exam should have extended the text of the model court decision.

The participants of the examination should have scored at the anonymous tests at least 54 points. So many points were received by 86 persons. For a practical task, the number of points should be at least 72.

To the stage of interviews will be allowed 63 candidates who will get the highest marks on the joint result of testing and practical assignment.

It should be noted that the Supreme Intellectual Property Court will consider such cases: disputes concerning the rights to an invention, utility model, industrial design, trade mark; disputes regarding registration of patents and certificates; recognition of well known trademarks; disputes over the rights of the author and related rights; disputes regarding the disposal of intellectual property rights; on protection against unfair competition.

Additionally, the Commission will soon announce about a competition to the Appeals Chamber of the High Court of Intellectual Property.

The new language bill passed the first reading

On October 4 the draft law «On ensuring the functioning of the Ukrainian language as a state» No. 5607-d passed the first reading.

The bill defines the procedure for the functioning and application of the Ukrainian language as a state in all spheres of social life in Ukraine, except for the sphere of private communication and the implementation of religious rites.

The document provides for the establishment of a National Commission on Standards for the State Language, which will monitor compliance with the requirements for the appropriate level of language proficiency and the establishment of the Government Commissioner office for the Protection of the State Language.

The bill stipulates that state officials will be forced to receive certificates of proficiency in the Ukrainian language.

The document amends the Criminal Code of Ukraine and the Code of Ukraine on Administrative Offenses. These changes determine the conditions for bringing criminal or administrative liability for the violation of language legislation.

The parliament has extended the special status of the Donbas’ separate territories

On October 5 came into force the Law of Ukraine «On Amendments to Article 1 of the Law of Ukraine «On special procedure for local governments in parts of Donetsk and Lugansk regions», approved by the Parliament and signed by the President of Ukraine on October 4, 2018.

The law continues the special procedure for local self-government in certain districts of the Donbas until December 31, 2019.

The law on the special status of Donbass was adopted September 16, 2014, in the framework of the Minsk agreements. The law introduces a special status for the territories that the forces of antiterrorist operation did not control at the date of enactment. The list of districts and settlements, in which a special procedure for local self-government is introduced, is determined by the decision of the Verkhovna Rada dated March 17, 2015.

The normative-legal act provides the state support to the socio-economic development of these territories.

State support is to introduce a regime of economic and investment activity aimed at restoring industrial objects, transport and social infrastructure, housing stock, redirecting industrial potential, creating new jobs, attracting investments and loans for the restoration and development of facilities located in these districts of Donetsk and Luhansk regions.

In separate districts people’s police units may be set up to protect public order, according to the decision of local authorities.

People’s deputies have simplified the procedure for extradition of offenders

The Verkhovna Rada adopted the Law of Ukraine «On Amendments to the Criminal Procedural Code of Ukraine in connection with the ratification of the Third Additional Protocol and the Fourth Additional Protocol to the European Convention on the Extradition of Offenders».

The law amended Chap. 44 «Issuance of persons who committed a criminal offense (extradition)», in particular articles 575, 576, 581, 583-585, 589, 591, 593, as well as article 208 «Detention by an authorized official» of the Criminal Code the Procedural Code of Ukraine, and the new wording of Article 588 «Simplified Procedure for the Issuance of Persons from Ukraine» was introduced.

The changes are aimed at implementing the provisions of the Third and Fourth Additional Protocols to the European Convention on the Extradition of Offenders and improving the existing procedure for extradition of offenders from Ukraine.

Now, a person may apply for a simplified extradition order immediately after being detained in connection with an international search without waiting for a formal extradition request. The law shortens the term of such a person’s detention on the territory of Ukraine for the purpose of extradition to another state.

Also Article 588 stipulates that the simplified extradition procedure does not apply in case of bringing a person to criminal liability or serving a sentence on the territory of Ukraine, if there is reason to believe that extradition may conflict with the interests of protecting the national security of Ukraine or that the wanted person is a citizen of Ukraine.
