The Verkhovna Rada has appointed judges of the Constitutional Court

The Verkhovna Rada of Ukraine appointed two judges of the Constitutional Court of Ukraine On September 20, 2019.

The judges are Irina Zavgorodnyna and Oleg Pervomaisky. In addition to them, Mykola Korotkevich and Natalia Yakymchuk claimed their positions

It should be noted that the Constitutional Court of Ukraine consists of eighteen judges – six judges are appointed by the President, six – by the Verkhovna Rada and the six – by Congress of Judges of Ukraine.

At present, 16 judges have been working in the Constitutional Court. From the President’s quota: Oleksandr Tupitsky, Viktor Kolisnyk, Volodymyr Moysik, Vasyl Lemak, Serhiy Holovatyi and Alexander Kasminin, from the quota of the Congress of Judges of Ukraine: Mikhail Gultai, Mikhail Zaporozhets, Natalia Shaptala, Alexander Litvinov, Viktor Krivenko, Viktor Gorodovenko, from the quota of Verkhovna Rada of Ukraine: Stanislav Shevchuk, Sergey Sass, Igor Slidenko, Mykola Melnyk.

According to Article 9 of the Law of Ukraine «On the Constitutional Court of Ukraine», the term of office of a judge is 9 years without the right to re-election.

A judge of the Constitutional Court of Ukraine enters into office from the date of his oath.

People’s deputies have renewed the composition of the Central Election Commission

The Verkhovna Rada of Ukraine dismissed members of the Central Election Commission in connection with the expiration of the term of office and appointed new members.

13 people were released: Astakhova Tamara, Danilevsky Yuri, Zhidenko Igor, Lukash Tetyana, Mager Andriy, Osadchuk Alexander, Okhendovsky Mikhail, Raynkovskyi Bronislav, Usenko-Chorna Zhanna, Chupakhin Alexander, Shvets Julia, Shelestov Alexander, Sheludko Valery.

At the same time, Kateryna Mashnitskaya and Oleg Didenko, whose terms of office expire in 2021, retain their positions.

At the same time, the Council appointed 14 members of the Commission, proposed by the President. They are: Alla Basalayeva, Natalia Bernatskaya, Mikhail Verbensky, Andriy Yevstigneev, Irina Yefremova, Olga Zheltova, Oleg Konopolsky, Svetlana Kustova, Olga Lotyuk, Vitaliy Plucar, Yevhen Radchenko, Tetyana Slipochuk, Leonty Shipilov and Tetyana Yuzkova.

It should be noted that on September 18, the Verkhovna Rada increased the number of the Commission’ members from 15 to 17. Thus, now the Central Election Commission has one vacancy.

According to the law, the term of the powers of the Central Election Commission’ members is 7 years. The members of the Commission (on the proposal of the President) appoints and dismisses the Verkhovna Rada.

The Verkhovna Rada sent to the Constitutional Court amendments to the Constitution

The Verkhovna Rada has included in the agenda and approved to send to the Constitutional Court of Ukraine the Presidential Draft Law No. 9037 on amending the Constitution of Ukraine on the strategic course of the state for acquiring full-fledged membership of Ukraine in the European Union and the North Atlantic Treaty Organization.

The Constitutional Court will check the bill for compliance with the requirements of Articles 157 and 158 of the Constitution of Ukraine.

It should b noted that the bill completes paragraph five of the preamble with the words «and confirming the European identity of the Ukrainian people and the irreversibility of the European and Euro-Atlantic course of Ukraine».

The Constitution also excludes the provision for the use of existing military bases in Ukraine for the temporary stay of foreign military formations under lease terms in accordance with international treaties.

In addition, people’s deputies included in the agenda the bill number 6236, filed by 174 deputies, on changes to Article 41 of the Constitution of Ukraine regarding the realization of the rights of Ukrainian citizens to land, the preservation of ownership of agricultural land in the hands of Ukrainian citizens and sustainable rural development on the basis of farms.

It should be noted that the document proposes to add to article 41 of the Constitution of Ukraine a new part of the following: «The basis of the agricultural system of Ukraine is a farm».

The bill will be sent to the Constitutional Court of Ukraine in order to obtain a conclusion as to whether it meets the requirements of Articles 157 and 158 of the Constitution.

The Parliament approved amendments to the Criminal Procedure Code regarding the closure of criminal proceedings

The Verkhovna Rada adopted the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on Improving Enforcement of the Rights of Participants in Criminal Proceedings and Other Persons by Law Enforcement Bodies during Pre-trial Investigation».

The Ministry of Justice states that the adoption of this law will increase the level of protection of the rights of persons during the pre-trial investigation of criminal offenses and will increase the responsibility of officials, officials of law enforcement agencies for improper performance of their duties.

The law amended Articles 220, 284, 303, 309 of the Code of Criminal Procedure. Among the innovations is the right of the parties to the proceedings to file a petition for the closure of criminal proceedings on the grounds of absence of an offense, absence of a crime, entry into force of a law that cancels a criminal liability or when a tax compromise has been achieved. It is also allowed to appeal to an investigating judge with a petition for the closure of criminal proceedings if the time limits set for the pre-trial investigation have expired.

It is provided that the investigator, the prosecutor is obliged to consider such a request within 3 days from the moment of filing and to satisfy if there are appropriate grounds. It is stipulated that the decision of the investigating judge to refuse to satisfy the relevant complaint may be appealed against.

In addition, the Law amended Article 307 of the Code: it provides for the strengthening of the responsibility of officials, officials of law enforcement agencies for improper performance of their duties in the course of pre-trial investigation. It is envisaged that the decision of the investigating judge, who is satisfied with the complaint about the decision, action or inaction of the body of pre-trial investigation, is sent to the head of the body, an officer of which is an investigator or prosecutor, to organize an official investigation and to resolve the issue of bringing the perpetrators to justice.

The law also amended Article 130 of the Code, Article 1191 of the Civil Code, Articles 2, 4 of the Law of Ukraine «On the Procedure for Compensation of Damage Inflicted on Citizen by Unlawful Acts of Bodies Performing Operative-Investigative Activities, Prudential Investigations, Prosecutors and the Court». They provide for the possibility of the state in the case of compensation for damage caused by an investigator or prosecutor (at the expense of the State Budget) to apply the right of reciprocity to the perpetrators in case of establishing in their actions not only a criminal offense, but also in the presence of signs of disciplinary misconduct.

People’s deputies presented a draft state budget for 2019

The Government presented a draft state budget for 2019 in the Verkhovna Rada of Ukraine (Bill No. 9000) on September 21, 2018.

The draft law of Ukraine establishes a subsistence minimum per person per month in the amount: from January 1, 2019 – 1 853 UAH, from July 1 – 1 936 UAH and from December 1 – 2 027 UAH.

For able-bodied persons: from January 1, 2019 – 1 921 UAH, from July 1 – 2 007 UAH and from December 1 – 2 102 UAH.

For persons who have lost their ability to work (minimum pension): from January 1, 2019 – 1,497 UAH, from July 1 –1 664 UAH and from December 1 – 1 638 UAH.

The minimum salary in 2019 is proposed to set the amount of 4173 UAH.

In addition, the budget provides for the Supreme Court of Ukraine funds in the amount of 2 billion UAH. The Constitutional Court of Ukraine should receive 211 million UAH in 2019. 217 million UAH is foreseen for the Supreme Anti-Corruption Court, and 30 million UAH – for the High Court on Intellectual Property.

For the State Judicial Administration of Ukraine and for the administration of justice local and appellate courts are scheduled 13.6 billion UAH.

Implementation of court decisions in favor of judges and employees of the court apparatus is planned to be financed in the amount of 5 million UAH.

For the State Bureau of Investigations is foreseen 1.1 billion UAH, and for the National Anti-Corruption Bureau of Ukraine – 867.5 million UAH.

For the General Prosecutor’s Office there are planned expenditures of 7.2 billion UAH, for the Specialized Anti-Corruption Prosecutor’s Office – 127 million UAH and for the National Police – 28.8 billion UAH.

It should be noted that according to the schedule of consideration by the Verkhovna Rada of the draft state budget, the first reading of the bill is scheduled for October 18 or 19.
