The Law on changing the subordination of religious organizations came into force

The Law of Ukraine «On Amending Certain Laws of Ukraine on Subordination of Religious Organizations and the Procedure for State Registration of Religious Organizations with Legal Status» came into force on January 31, 2019.

The law establishes the procedure for religious organizations to change the subordination of their centers – in Ukraine or abroad.

The decision to change the subordination and make the appropriate changes or additions to the statute shall be made by at least two thirds of the number of members of the religious community necessary for the recognition of the assembly as authorized.

A change in the subordination of a religious community does not affect the content of property rights of such religious communities.

Part of the society, disagreeing with the decision to change the subordination, has the right to form a new community and enter into an agreement on the procedure for using the religious building and property with their owner (user).

In the event of a change in their subordination, a religious organization reports this to the central executive body implementing state policy in the sphere of religion, or regional, Kyiv and Sevastopol city state administrations, and in the Autonomous Republic of Crimea – the Council of Ministers of the Autonomous Republic of Crimea. These decisions should be posted on the official websites of government agencies.

The statutes (regulations) of religious organizations must be brought into line with this Law within one year from the day it enters into force.

ECHR forms lists of Ukrainian lawyers for representation in court

The European Court of Human Rights Commissioner received a letter from the European Court requesting information on the list of lawyers’ associations in Ukraine, including their branches in areas where applicants may seek legal aid for representing their interests in the European Court.

Information that can provide qualified legal assistance to applicants in proceedings before the European Court can be sent to info@unba.org.ua.

The deadline for submitting information: until February 4, 2019.

The list of lawyers’ associations and their branches in the regions will be given to the Commissioner for European Court of Human Rights.

The European Court of Human Rights is an international judicial body whose jurisdiction extends to all Council of Europe member states that have ratified the Convention for the Protection of Human Rights and Fundamental Freedoms, and includes all matters relating to the interpretation and application of the Convention, including interstate cases and individual complaints.

Council of Judges of Ukraine approved the work plan for 2019

The Council of Judges of Ukraine approved one-time and common goals for 2019. The plan includes only 21 points. Each item has a deadline.

The Council of Judges, in particular, should develop standards for organizing the work of the court and a code of judicial ethics and rules of conduct for court personnel, as well as update measures on the independence of judges.

It is planned to restore the publication of the journal «Judicial Self-Government», to develop amendments to the Regulation on the stimulation and approve the mantle design.

It is planned to create a permanent debate club with the participation of journalists.

The Council of Judges will develop common ethical standards with prosecutors and lawyers and establish typical responses to the facts of disseminating false information or information in the media, undermining the authority of the judiciary.

Also in the list of goals is approval of the procedure for appointing chairmen of courts in the presence of conflict and crisis situations in these courts and a plan for the financial needs of the CJU committees.

In addition, measures to provide judges with office accommodation, rules of conduct for court personnel and the procedure for providing legal protection for judges by the Council of Judges of Ukraine will be developed.

Finally, the plans include the preparation of a draft amendment to the Law of Ukraine «On the Judicial System and Status of Judges» regarding the change of the mechanism for electing judges to administrative positions.

A new deputy head of the National Police Department has been appointed

The head of the Ministry of Internal Affairs Arsen Avakov signed a submission on the appointment of Oleg Kozlovsky as Deputy Chairman of the National Police.

Kozlovsky will head the Department of Operational Support.

The main function of the Department of Operational Support of the National Police is to identify hidden criminal processes that encroach on public safety and law and order. He will also be responsible for coordinating the department with other units of the National Police and executive authorities.

Criminal proceedings in which free legal aid is provided will be analyzed by legal experts

The experts will conduct legal analysis of criminal proceedings, which provide free legal aid.

The innovation was launched by the Coordination Center together with the National Association of Attorneys of Ukraine, the Ukrainian Helsinki Human Rights Union, the Kharkiv Human Rights Protection Group and the Ukrainian Legal Aid Foundation.

The creation of this mechanism is intended to provide effective and qualified legal assistance to vulnerable groups of the population

The Coordination Center offers the leaders of law associations/bureaus, lawyers to contribute to improving the quality assurance process for legal assistance.

«It is extremely important for us to form a common vision of the evaluation criteria, the formation of methods and approaches for such an analysis, and also to rely on your support and assistance. The Coordination Center, relying on the capabilities of the «Pravokator» network of legal clubs and the system of legal assistance, will assist lawyers cooperating with the system in realizing their creative potential and professional development», – the report states.
