Reception of documents for a new contest to the Supreme Court and a competition to the Supreme Anticorruption Court ended on September 14.

It should be noted that the High Qualifications Commission of Judges of Ukraine has announced a competition for 78 posts to the Supreme Court (a total of 196): to the Cassation Administrative Court  – for 26 posts, to the Cassation Economic Court –  for 16 posts, to the Cassation Criminal Court – for 13 posts and to the Cassation Civil Court – for 23 posts.

The Supreme Anticorruption Court has announced a competition for 27 posts, as well as separately for 12 posts to the Court of Appeal.

We will also add that the deadline for submission of proposals from international organizations to candidates for the Public Council of International Experts has also been completed. This Council will assist the Commission in the contest to the Anti-Corruption Court.

It should be noted that six members of the Public Council of International Experts are appointed solely on the basis of proposals from international organizations with which Ukraine cooperates in the field of prevention and counteraction to corruption.

Applicants must have an impeccable business reputation; high professional and moral qualities; public authority; experience in other countries for not less than five years from the implementation of procedural guidance, the maintenance of state prosecution in court or the execution of justice in cases related to corruption.

The Constitutional Court is considering a complaint regarding the reduction of judges’ salaries

On September 12, the First Senate of the Constitutional Court of Ukraine, in the form of a written proceeding, commenced consideration of a complaint regarding the reduction of official salaries of judges.

A constitutional complaint was filed by a former judge of the High Specialized Court for the Examination of Civil and Criminal Cases Mykola Demianosov. He asks to check whether the provisions of paragraphs 3, 9 of Section II «Final and Transitional Provisions» of the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine» dated December 6, 2016, No. 1774-VIII, are in conformity with the Constitution of Ukraine.

Thus, according to Clause 3 of Section II «Final and Transitional Provisions», the Law does not apply the minimum wage as the estimated amount for the determination of salaries and wages of employees and other payments. Until the introduction of amendments to the laws of Ukraine regarding the non-application of minimum wages as the estimated value, it is applied in the amount of 1600 UAH. In accordance with clause 9 of Section II «Final and Transitional Provisions» of the Law, to bring the legislative acts into compliance with the Law, they shall be applied in a part which does not contradict the Law.

Demianosov claims that the disputed provisions of the Law led to a reduction of more than twice the salaries of judges who did not pass the qualification assessment. That is, to significantly reduce the size of the material support of such judges and reduce the constitutional guarantees of their independence, which contradicts part one of Article 126 of the Constitution of Ukraine.

In the opinion of the petition author, the fact that the provisions of clauses 3 and 9 of Section II «Final and Transitional Provisions» of the Law establish the estimated amount for determining the salaries of judges different from the estimated value established by the law on the judicial system, as well as the priority of the application of these provisions of the Law is not in accordance with the second paragraph of Article 8, part two of Article 130 of the Constitution of Ukraine.

The challenged provisions of the Law, as the complainant considers, also violate the right of everyone guaranteed by the Constitution of Ukraine to judicial protection of his rights and freedoms in the context of reducing the constitutional guarantees of the judges’ independence and the right of everyone to own, use and dispose of their property, the results of their intellectual and creative activity.

UNBA criticized the presidential bill on advocacy

Ukrainian National Bar Association has criticized Presidential Bill No. 9055 «On Advocacy and legal profession» and demands that the document be verified by the Venice Commission.

UNBA states that this bill may lead to false or obviously harmful legal experiments and create chaos in the legal regulation of advocacy.

In particular, the bill poses significant threats to the reduction of lawyers’ professional rights. In particular, the extended concept of a lawyer’s request is offset by the possibility of failing to respond to these inquiries. The bill envisages the addition of the Criminal Procedure Code, which will allow the court to determine the abuse of the parties procedural rights. The possibility of violations in conducting suspicion of special subjects has been expanded.

In addition, it allows the investigator or prosecutor to bring an attorney from the system of free legal aid at his own discretion, which will work in parallel with the lawyer under the contract. It overrides the right to freely choose a defender and turns lawyers into statisticians.

In the part of the lawyer’s self-government, the bill envisages the elimination of the existing organs of self-government as legal entities and the creation of new bodies according to another model. At the same time lawyers’ conferences take place in the format of general meetings of lawyers of the region.

As a reminder, the Draft Law No. 9055 on «Advocacy and legal profession» was introduced by the President on September 6, 2018.

On September 14, 2018, people’s deputies submitted to the parliament an alternative bill No. 9055-1.

Ukraine won Russia appeal in the case of «Eurobonds»

The Court of Appeal of England returned to the new trial the case on the suit to recover from Ukraine in favor of Russia debt on eurobonds at $ 3,075 billion.

Judge decided that the High Court of London mistakenly failed to consider the arguments of the Ukrainian side. Thus, now the case will be heard within the framework of a complete procedure that will delay the possibility of debt collection in favor of Russia.

As a reminder, in December 2015, Ukraine made a default on Eurobonds worth $3 billion, redeemed by Russia in December 2013. Kiev offered Moscow to restructure debt on common terms with commercial lenders. Russia refused to discuss this option, insisting on the sovereign nature of the debt.

The debt had to be paid by January 1, 2016. However, in December 2015, Ukraine imposed a moratorium on servicing this debt.

On February 17, 2016, Russia sued the London High Court for debt collection on Eurobonds. On March 29, 2017, the court approved the acceleration of the proceedings, effectively agreeing with the presence of obligations on Eurobonds. The court found that a transaction is a standard debt transaction, although it was carried out under unusual conditions.

At the same time, the court decision noted that some of its definitions need to be clarified and there are many important issues that the court should deal with.

Thus, on May 26, 2017, the London High Court upheld Ukraine's petition for suspension of enforcement from March 29, 2017 until completion of the consideration of Ukraine’s appeal in the Court of Appeal.

The decision of the London Court of Appeal can still be appealed to the Supreme Court.
