President has appointed judges of the new Ukrainian Supreme Court

President of Ukraine Petro Poroshenko has signed the decree on appointment of 114 judges of the new Supreme Court.

Deputy Head of the Administration of the President of Ukraine Oleksiy Filatov read out the decree at the solemn oath taking ceremony of the judges of the Supreme Court of Ukraine.

According to the President, this contest with a high level of competition was conducted under an extremely vigilant public scrutiny, with a thorough examination of the candidates by all anti-corruption bodies.

Various experts became judges of the new Supreme Court: someone has a great deal of experience in the judicial system, someone came to the post of judge after many years of advocacy activity, someone was a human rights activist, a scientist or a lecturer.

“Every fourth judge of the new Supreme Court is a lawyer or a scientist. I want to inform the society that this is unprecedented, since nobody outside of the judicial system had the right to stand for election before. Today, these opportunities are available,” Petro Poroshenko emphasized.

Сonsolidation of courts will begin in Cherkasy and Chernivtsi

From Cherkasy and Chernivtsi decided to start consolidation of district courts in Ukraine.

The Administration of the President of Ukraine prepared a draft decree on the elimination of general local courts in Chernivtsi and Cherkasy regions and the formation of district courts.

It is supposed to eliminate Pervomaisky, Sadhirsky and Shevchenko District Courts of the city of Chernivtsi and form a Chernivtsi District Court of 26 judges.

Cherkasy and Chigirinsky district courts of Cherkassy oblast, Prydniprovsky and Sosnivsky district courts of Cherkassy will be liquidated and the Cherkassy District Court with 45 judges will be formed.

The purpose of such consolidation is to save budget funds, to balance the burden on judges, and to improve access to justice.

The High Council of Justice fully supported the President's proposal to eliminate seven local general courts and instead establish two district courts in Cherkasy and Chernivtsi.

Rada adopted bill "Housing and communal services"

The Parliament adopted the law on housing and communal services. 

The law runs “housing and communal services are result of the economic activity aimed at providing conditions of accommodation and stay of persons in residential and non-residential premises, houses and constructions, complexes of houses and constructions according to standard rates, regulations, standards, procedures and rules”.

The Law of Ukraine “On Housing and Communal Services” defines basic principles of organizational, economic relations that arise in the sphere of provision and consumption of housing and communal services between their producers, providers and consumers, as well as rights and duties of the latter. The subjects of this Law are bodies of executive power, bodies of local self-government, owners, producers, providers and consumers of housing and communal services. Control over observation of standards, norms, order and rules in the sphere of housing and communal services shall be performed by the central bodies of executive power and other bodies of executive power specially authorized thereto, as well as bodies of local self-government.

The law frames state policies in the housing and communal services sphere, terms of reference for public authorities and local government in the sphere, nomenclature of the housing and communal services, participants in legal relations of the sphere, providers of the services, rights and duties of the providers and consumers of housing and communal services,terms and procedures of payment for the services, the tariffing and billing, procedures for the provision of the services, etc.

The law provides for timely informing the service consumers of planned changes in the tariffs accompanied with the rationale. The law also provides for the improper performance liability, and stipulates the order of submitting the consumers’ claims.he consumer has the right not to pay the cost of communal services (except for heat energy), if they do not use them for the period of temporary absence in the premises for more than 30 calendar days.

In Ukraine Election Code was adopted in first reading

The Verkhovna Rada adopted Election Code of Ukraine in the first reading.

The Electoral Code defines the procedures for conducting presidential elections, deputies to the Verkhovna Rada, deputies of rural, settlement, city (small towns), city districts, district councils, deputies of cities (big cities), regional councils and village, town, city mayors and elder

Elections of people's deputies of Ukraine are proposed to be conducted on the basis of a proportional system based on electoral lists of candidates for deputies from political parties. It is proposed to apply "open" lists of candidates.

It is proposed to apply a similar electoral system also for elections of deputies of the Verkhovna Rada of the Autonomous Republic of Crimea, regional councils.

Elections of deputies of the village, settlement council, city council (cities with the number of voters to 90 thousand people), district councils in the city council is proposed to hold in the system of relative majority in multi-mandate constituencies. At least two and not more than four deputies may be elected in each constituency. At the same time, elections to deputies of the district council are proposed to be conducted in the system of the relative majority in multi-mandate constituencies, the borders of which coincide with the borders of villages, settlements (communities), cities that are part of the respective district. At least two and not more than four deputies may be elected in each constituency.

After the enactment of the Electoral Code, the laws "Elections the President of Ukraine", "Elections of Deputies in Ukraine", "Local Elections" will become invalid.

Seven candidates have been nominated to the Constitutional Court by the parliament's quota for the Contest

The Verkhovna Rada of Ukraine nominated seven candidates for two vacant judge positions to the Constitutional Court under a parliamentary quota.

There are two vacant posts in Ukrainian Constitutional Court, which has to be filled by the Verkhovna Rada.

Three parliamentary factions nominated their candidates for vacancies: a judge of the High Specialized Court Irina Zavgorodnyf, professor of the Financial Law Department of law school of the Taras Shevchenko National University of Kyiv Natalia Yakymchuk, Judge of the Supreme Court of Ukraine Mykola Korotkevych, Associate Professor of the Civil Law Department of the Taras Shevchenko National University of Kyiv Oleg Pervomaisky.

Three other candidates independently nominated their candidacies to participate in the competition to the Constitutional Court. This is the deputy head of the department for comparative legal analysis of the legal department of the UCC Natalia Denisenko, retired judge Vasyl Zaitsev, and the head of the law school of the Chernivtsi National University Oksana Shcherbanyuk.

The Justice Committee will consider the documents submitted by the candidates and decide who will continue to participate in the competition.
