Ukrainian Judges’ Congress has appointed a judge of the Constitutional Court

Ukrainian Judges’ Congress has elected Viktor Gorodovenko as a judge of the Constitutional Court of Ukraine. 186 delegates of the congress have voted for the appointment of the chairman of the appellate court of Zaporiz'ka oblast for the position of a constitutional judge.

Also there were five other candidates besides Gorodovenko: two Lviv’s judges Leontovich and Savulyak, a judge of the High Special Court Kryzhanivsky, a judge of the Supreme Court of Ukraine Humenyuk, and a judge of the Appellate Court in Dnipropetrovsk Chumak. However, the rest of the candidates have received less votes compared to the support of most delegates of the judge Gorodovenko.

Viktor Gorodovenko has a 24-year experience as a judge. He worked at the city court of Melitopol and a judge of the appellate court of Zaporiz'ka oblast, where he served for 12 years as chair of the court.

On November 21, Viktor Gorodovenko will take the oath of judge of the Constitutional Court, after which he will join to the crew of constitutional judges.

The Verkhovna Rada has adopted the Law on Amendments to the Criminal Procedural Code on conducting searches

The Verkhovna Rada of Ukraine has adopted a draft law on ensuring compliance with the rights of participants in criminal proceedings and other persons by law enforcement agencies during the prejudicial inquiry, which encapsulates instruments for counteracting any unjustified pressure on Ukrainian enterprises, including pressure from the law enforcement agencies.

The adopted document reforms the procedure of search and seizure of things at enterprises during a pre-trial investigation and strengthens the protection of the rights of businesses.

The law introduces compulsory video recording of the search process. Without such records, the evidence obtained will be recognized as inadmissible. In this case, the party of protection gets the right to fix the search process.

Also, a person in whose premises the search is being carried out will be entitled to the assistance of an advocate at any stage of a search.

To protect the participants in criminal proceedings from unjustified seizure of documents and computer equipment, the adopted law obliges the prosecution to substantiate the need to seize the originals of documents or their copies from persons in whose premises a search is being conducted.

Also, law enforcement officers, in general, will be prohibited from seizing computer hardware, and they must make copies of any required data with the involvement of relevant experts.

Attorneys of the company will have the right to be involved in the search at any stage. Evidence obtained during a search for which a defender was not admitted will also be declared invalid if the lawyer proves in court that he is not allowed to participate in the search.

The law prohibits the removal of originals of financial and economic documentation, computer equipment, servers and mobile phones of business entities. It also provides for a prohibition of repeated infringement of closed criminal proceedings and provides reasonable time for criminal proceedings.

Persons whose rights are restricted are entitled to challenge the inaction of the investigator and make a request for the application of reasonable time limits for proceedings. At the same time, representatives of business will be entitled to confirm the registration of a criminal case within 24 hours from the moment of entering the information into the register of pre-trial investigations.

Another important novelty of the Law is the creation of a government commission consisting of human rights activists, representatives of business associations and state authorities, which will consider completed cases and will assess the lawfulness of the actions of law enforcement officers with regard to business representatives.

The state budget for 2018 was adopted in first reading

The Verkhovna Rada adopted in the first reading a draft law on the state budget of Ukraine for 2018 and sent the government its recommendations for its revision.

The draft budget for 2018 provides for an increase in the minimum wage from 3,200 to 3,723 UAH.

The minimum living wage per person has proposed to increase from July 1 to 1,777 UAH and from December 1 to 1853 UAH. For children under the age of 6, the subsistence minimum will increase from 1492 to 1559 UAH, and from December 1 to 1626 UAH. For children aged 6 to 18, it will be 1,944 UAH, and from December 1 - 2,227 UAH.

The government has set the minimum pension in the following amount: from January 1, 2018 – 1373 UAH, from July 1 – 1435 UAH, from December 1 – 1497 UAH.

The size of the state social assistance to low-income families is planned to increase by 250 UAH for each child aged 0 to 13 years, and for each child from the age of 13 to 18 years - by 500 UAH.

The draft law for the next year takes into account inflation at 7%, and the dollar is laid at the level of 30.1 UAH.

The government promises that the draft budget for 2018 would be approved at second reading until December 10.

The number of judges in the Supreme Court and higher specialized courts decreased

Two chambers of the Supreme Court of Ukraine from four after the appointment judges of the new Supreme Court by the President have stopped the consideration of cases.

The Judicial Chamber on Administrative Cases and the Judicial Chamber on Commercial Cases stopped hearing the cases, but two other chambers - civil and criminal - continue to examine cases.

Almost half of the judges of the High Specialized Court of Ukraine for Civil and Criminal Cases were assigned to the new Supreme Court and terminated the consideration of cases in the cassation instance.

The competition commission has elected management of the State Bureau of Investigation

The competition commission has completed the competitive selection for the position of the director, first deputy and deputy of the State Bureau of Investigations and identified the winners.

The competition commission has elected former prosecutor, the head of the department of Legal Company "Sector of Law" Roman Truba as director of the State Bureau of Investigation.

In the competition for the position of the first deputy of director of the State Bureau of Investigations won the head of the department of procedural leadership of the Prosecutor General 's Office of Ukraine Olga Varchenko.

Competition commission recommended to appoint Oleksandr Buryak as a Deputy Chief of the State Bureau of Investigations.

The Competition Commission will submit to the Prime Minister on the appointment of Roman Truba as director of the State Bureau of Investigations. After approval Roman Truba  by the government, the corresponding submission of appointment will be handed over to the President, who should appoint the director of the State Bureau of Investigations.

The Verkhovna Rada has approved a bill on making December 25 an official non-working holiday instead of May 2

The Verkhovna Rada has adopted changes to Article 73 of the Labor Code of Ukraine.

According to the changes, December 25 (Christmas on the Gregorian calendar) is recognized as the official holiday in Ukraine and a holiday on May 2 has canceled.

Thus, the total number of non-working days in Ukraine don’t increase  - 11 days: January 1 - New Year; January 7 and December 25 - Christmas; March 8 - International Women's Day; 1 - Labor Day; May 9 - Victory Day over Nazism in the Second World War (Victory Day); June 28 - Constitution Day of Ukraine; August 24 - Independence Day of Ukraine and October 14 - Day of the defender of Ukraine and one day (Sunday) - Easter (Easter) and one day (Sunday) - Trinity.

At the same time, deputies also propose to abandon the postponement of the weekend on Monday, when the holiday day falls on Sunday. However, so far, this is only a legislative initiative.
