A lawyer was killed in Kropyvnytskyy

On August 22, in the city of Kropyvnytskyy, solicitor Olexander Ivanov was killed near pre-trial detention center No. 6.

Unknowns fired from automatic weapons from the car, a lawyer died on the spot.

The Ukrainian National Bar Association appealed to law enforcement agencies – the Prosecutor General’s Office and the National Police to take control of this crime investigation.

The Association insists that the murder of a lawyer is related to professional activities.

«Advocacy has always been risky, but in recent years, our profession has been associated with a threat to the lives of lawyers. In this context, any initiative to limit the professional rights of lawyers or the content of the lawyer's guarantees is extremely harmful and will jeopardize the entire institution of professional legal assistance.

We urge the media not to disseminate unverified information about the deceased, and not to allow law enforcement officers to silence this crime», the report stated.

The instruction for clerical work in local and appeal courts has been approved

The State Judicial Administration of Ukraine adopted Order No. 814 «On approval of the Instruction for the Proceedings in Local and Appeal Courts of Ukraine».

The instruction, which consists of 21 sections, establishes the procedure for the automated (electronic) processing, accounting and control of documents, court cases using an automated court document management system and paperwork.

Courts can create documents of a temporary (up to 10 years inclusive) storage period only in electronic form, subject to the availability of appropriate technical support, taking into account the requirements of the legislation of Ukraine and the Instruction.

The instruction defines the rules and the procedure for working with all documents, except for those that contain information with limited access.

All court documents are compiled in the state language. In cases provided for by the international treaty of Ukraine, the court draws up a procedural document in the language provided for by the relevant international treaty of Ukraine, or adds to it a translation into such a language, certified in accordance with the legislation of Ukraine.

The courts carry out periodic (at least once a year) checks of the status of paperwork in units of the court apparatus.

Violation of the requirements of the Instruction, as well as negligent storage, intentional damage, unjustified destruction, falsification, concealment, theft, illegal transfer of official documents to another person, including electronic ones, as well as illegal access to them or an electronic database entails liability in accordance with applicable law.

Court documents from the time of creation (receipt) and until the transfer to the court archive are stored at the place of formation or centralized in the court office in accordance with the approved nomenclature of cases.

New fines for untaxted cars are applied

Starting August 22, 2019, new penalties are introduced in Ukreaine for violations when moving vehicles in the customs regimes of temporary import and transit.

According to the new rules, if the delivery time for personal and commercial vehicles is exceeded from 20 to 30 days, a fine of 85 thousand UAH is provided. If the term is exceeded by more than 30 days, as well as in the event of loss or decommissioning of the vehicle, the fine will reach 170 thousand UAH or the confiscation of such cars.

Similar are amounts of fines if the time limits for temporary importation of vehicles for personal use and commercial purposes are exceeded. So, an excess of 20 to 30 days – the amount of the fine will be 85 thousand UAH, more than 30 days, as well as in case of loss or decommissioning of the vehicle – 170 thousand UAH or confiscation.

In addition, liability is provided for the transfer of a personal vehicle temporarily imported into the customs territory of Ukraine or placed under the customs transit regime into the possession or disposal of another person, as well as the use of such a vehicle for commercial purposes. For such a violation you will have to pay a fine of 2 thousand non-taxable minimum incomes of citizens –34 thousand UAH.

Until now, owners of cars with foreign registration could register their cars and avoid such fines. The introduction of increased administrative responsibility for violations during the import of vehicles was postponed until August.

It should be noted that the President of Ukraine Volodymyr Zelenskyy plans to submit to the Parliament a bill on deferral of fines for three months. The project may be considered at the first session of the new Verkhovna Rada.

Changes in the National Police: reform of the cyber police, the release of regional leaders and the liquidation of the Department of Economic Defense

Minister of Internal Affairs Arsen Avakov announced the liquidation of the Department of Economic Defense of the National Police of Ukraine.

«Today in the state there is an urgent issue of creating a single body that will deal with the fight against financial and economic crimes – the Financial Investigation Service. Therefore, we must take the first steps. I propose to make a decision on the liquidation of the Department of Economic Protection of NPU», commented Avakov.

He noted that the professionals who worked in this department will continue to work.

In addition, he announced his intention to dismiss the heads of the Main Directorates of the National Police in the Lviv, Zakarpattia, Zaporizhzhya and Zhytomyr regions. Before that, the minister asked the head of the National Police, Sergiy Knyazev, in which areas there are poor indicators and complaints about the work of the departments’ heads. He accordingly listed the mentioned areas.

In addition, the National Police intends to reform its department of cyber police, said the chairman of the National Police.

According to him, a cyber police department will be created instead of inter-regional departments. In addition, additional employees and equipment will be sent to the cyber police.
