The Congress of Judges appointed two judges of the Constitutional Court of Ukraine and elected two members of the High Qualification Commission of Judges of Ukraine

The delegates of the XVII Extraordinary Congress of Judges appointed the judge of the Volyn Court of Appeal Petro Filiuk as the judge of the Constitutional Court of Ukraine: 151 delegates gave their votes for him.

The forum’s delegates also elected a retired judge Halyna Yurovska as a CCU’s judge. 145 delegates voted in favor of her.

Also, congress delegates voted to appoint members of the High Qualification Commission of Judges of Ukraine. According to the results of the first stage of voting, the majority – 148 votes were gathered by Oleksandr Panasiuk – judge of the Vinnytskyi Court of Appeal.

During the second vote, Tetiana Shyroian, a judge of the High Specialized Court of Civil and Criminal Cases of Ukraine, who gained 155 votes, was also elected as a member of the Commission.

President announces competition for High Council of Justice member

On October 30, 2019, President of Ukraine Volodymyr Zelensky signed Decree No. 785/2019 «Matters on the selection of candidates for the President of Ukraine to appoint members of the High Council of Justice».

The decree approves the provision on holding an open competition for the selection of candidates for the appointment of a member of the High Council of Justice under the quota of the President of Ukraine.

The competition will be held by a commission, which is composed of recognized experts in the field of law who are highly qualified and have extensive experience in this field, as well as an impeccable professional reputation.

The staff of the Commission is approved by the President of Ukraine.

The competition is held in three stages:

1) selection of candidates on the basis of submitted documents for interviews;

2) conducting interviews with selected candidates and determining, according to the results of the interviews, a list of persons in respect of whom a special audit is carried out in accordance with the law;

3) determination of candidates recommended for the implementation by the President of Ukraine of the appointment of members of the High Council of Justice.

Constitutional Court gave conclusions on two constitutional appeals of the Verkhovna Rada

The Constitutional Court of Ukraine provided conclusions on constitutional appeals of the Verkhovna Rada of Ukraine on draft law No. 1028 «On amending Article 85 of the Constitution of Ukraine (regarding advisory, advisory and other subsidiary bodies of the Verkhovna Rada of Ukraine)» and No. 1013 «On amending the Constitution of Ukraine (on abolition of the advocate monopoly)».

The Constitutional Court recognized that the bills are in accordance with the requirements of Articles 157 and 158 of the Constitution of Ukraine.

Draft law No. 1028 proposes to supplement the first part of Article 85 of the Constitution of Ukraine with paragraph 15 (1) of the following content: «creation, within the limits of the funds provided for in the State Budget of Ukraine, for the exercise of its powers of advisory, advisory and other subsidiary bodies».

Draft Law No. 1013 proposes to amend the Constitution of Ukraine by introducing Article 131 (2) in the new wording: «The independence of the bar is guaranteed. The principles of the organization and activity of the bar and the practice of the bar in Ukraine are determined by law. Only a lawyer protects a person from criminal charges».

According to the bill on the abolition of the lawyer monopoly, the Court notes that the proposed amendments to the Constitution of Ukraine expand the possibilities for representation in court.

The conclusion states that the concept of “providing professional legal assistance” is not identical to the concept of «representing a person in court». Providing professional legal assistance is carried out by lawyers, but representation of a person in court can be carried out at the choice of a person by a lawyer or other entity. The positive obligation of the state follows from this, is to ensure the participation of a lawyer in providing professional legal assistance to a person in order to ensure its effective access to justice at the expense of the state in cases provided by law.

The conclusion of the CCU is binding, final and such that it cannot be appealed.

The article on illegal enrichment was returned to the Criminal Code of Ukraine

On October 31, 2019, the Verkhovna Rada adopted the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on Confiscation of Illegal Assets of Persons Authorized to Perform the Functions of State or Local Self-Government, and Punishment for Acquiring Such Assets».

The law regulates, in particular, the peculiarities of lawsuit proceedings in cases of recognition of unjustified assets of persons authorized to perform the functions of the state or local self-government, and their recovery in the state revenue.

In this regard, the Civil Code introduces a separate ground for termination of ownership, the determination of the types of assets that can be declared unreasonable, and the limit on the value of such assets.

Criminal liability is imposed on government officials for acquiring assets that cost more than 15,000 tax-free minimum incomes that exceed their legal income.

The law, in particular, supplemented the Criminal Code with a new Article 3685 «Illegal Enrichment».

According to this rule, if the officials acquired into the property assets exceeding 6,000 500 non-taxable minimum incomes of citizens their legal income, then it is punishable by imprisonment for a term of 5 to 10 years with deprivation of the right to occupy certain positions or engage in certain activities for a term up to 3 years.

Acquisition of assets should be understood as their acquisition by a person authorized to perform the functions of the state or local government, as well as the acquisition of assets by another individual or legal entity, if it is proved that such acquisition was carried out on behalf of a person authorized to perform the functions of the state or local government, or a person authorized to perform the functions of a state or local government may directly or indirectly commit in relation to such assets actions are identical in meaning to the exercise of the right to travel by them.
