The Verkhovna Rada has amended procedural legislation

On October 4, 2019, the Verkhovna Rada adopted the Law of Ukraine «On Amending Certain Legislative Acts of Ukraine Regarding the Improvement of Certain Provisions of the Criminal Procedure Law».

Amendments are made to a number of articles of the Criminal Procedure Code of Ukraine, the laws «On Forensic Expertise», «On the Radio Frequency Resource of Ukraine», «On Amending Certain Legislative Acts of Ukraine Regarding Priority Measures for the Reform of the Prosecutor’s Office» and others.

The law, among other things, repeals the so-called «Lozov’s amendments» (except for the limitation on the time of pre-trial investigation) and grants the National Anti-Corruption Bureau of Ukraine and the State Bureau of Investigation the right to wiretap.

At the same time, it was decided not to abolish the rule of the Law «On the status of a people’s deputy», which prohibits the search and wiretapping of people’s deputies.

In addition, deputies left the right to cancel suspicions through the courts.

It is worth adding that according to the chairman of the parliamentary committee on law enforcement Denys Monastyrsky, amendments to article 27 of the Law on the Status of People’s Deputy and article 482 of the Code of Criminal Procedure relating to searches, listening and detention of people’s deputies will be submitted to a separate bill.

The Verkhovna Rada has updated the composition of the Central Election Commission

On October 4, 2019, the Verkhovna Rada adopted a resolution «On the Appointment of Members of the Central Election Commission of Ukraine».

The new composition of the Commision has been appointed. Central Election Commission includes 17 members/

Oleh Didenko was elected as the chairman of the CEC, and Serhii Dubovyk and Vitalii Plukar as their deputies.

On September 13, the Verkhovna Rada adopted a resolution «On the early termination of powers of the entire Central Election Commission». President of Ukraine Volodymyr Zelenskyi initiated the dissolution of the previous CEC because of «individual cases of illegal actions and inaction of the Central Election Commission».

The term of office of the CEC is 7 years. The deputies approved the latest composition of the CEC on September 20, 2018.

The Verkhovna Rada agreed to restart the work of the National Agency for the Prevention of Corruption

The Verkhovna Rada adopted the Law of Ukraine «On Amending Certain Legislative Acts of Ukraine Regarding Ensuring the Effectiveness of the Institutional Mechanism for the Prevention of Corruption».

The law changes the form of government of the National Agency for the Prevention of Corruption from collegial to sole. The Head of the National Agency will be appointed to the post by the Cabinet of Ministers of Ukraine in accordance with the results of the open tender.

The Cabinet of Ministers of Ukraine shall organize the competition within 45 days from the day the law enters into force. In this case, the powers of the members, the head of the apparatus, the deputy head of the apparatus of the National Agency shall be terminated ahead of time from the date of entry into force of the law.

The commission will include international experts. The commission may not include persons authorized to perform the functions of state or local self-government. In this case, unlike the existing procedure, a special examination will be carried out after the appointment of the selected candidate for the position.

It is also proposed to set up a commission to conduct an independent performance review of the National Agency, which will review the body’s work every two years.

The head of the National Agency may create six territorial bodies, the territory of which may not coincide with the administrative-territorial division.

People’s Deputies approved anti-raider law

On October 3, 2019, the Verkhovna Rada of Ukraine adopted the Law of Ukraine «On Amending Certain Legislative Acts of Ukraine Regarding the Protection of Property Rights».

The law aims to provide additional guarantees for the protection of property rights in Ukraine.

The authors of the law note that the current system of state registration of rights to real estate and corporate rights contains a lot of gaps and shortcomings and allows unscrupulous persons to gain control over the relevant assets in an unlawful way.

For example, practice has shown the inappropriateness of the further use of the institution of the so-called accredited entities, since a significant number of them took an active part in dubious or openly criminal registration actions.

Therefore, the legislative act provides for the termination of the activities of accredited entities, the introduction of the mandatory notarization of agreements on the alienation of corporate rights, the introduction of the principle of simultaneous execution of notarial acts and state registration of rights, increasing responsibility for violation of the relevant registration procedures.

The grounds for referring the case to the Grand Chamber of the Supreme Court have been changed

The Verkhovna Rada adopted the Law of Ukraine «On Amending Certain Legislative Acts of Ukraine on the Grounds for Referring the Case to the Grand Chamber of the Supreme Court and on the Terms for Returning Administrative Cases».

The law amends the Commercial Procedural Code of Ukraine, the Civil Procedural Code of Ukraine, the Code of Administrative Procedure of Ukraine regarding the limitation of cases of referral of cases to the Grand Chamber of the Supreme Court when appealing court decisions on grounds of violation of the rules of subject or subjective jurisdiction.

So, the transfer of court cases by the cassation courts for consideration by the Grand Chamber to the Supreme Court from these grounds may occur on the basis of the combined availability of the following grounds:

the existence of different jurisprudence in similar disputes in the courts of cassation of other jurisdictions;

the absence of conclusions of the Grand Chamber of the Supreme Court concerning substantive or subjective jurisdiction in such disputes;

statement by a party to the case challenging the court's violation of the rules of jurisdiction during the trial in the courts of the previous instance.

The law also stipulates that, after the appeal is over, the case files, except those stored exclusively in electronic form, are returned to the court of first instance, which examined it, within five days.

Upon termination of the cassation proceedings, the case files, in addition to those stored exclusively in electronic form, shall be returned to the court of first instance which examined it within ten days.

The Attorney General approved the procedure for attestation of prosecutors

On October 2, 2019, Prosecutor General Ruslan Riaboshapka approved a provision on the procedure for attestation by prosecutors.

The document establishes the procedure of attestation for prosecutors and investigative bodies of the prosecutor's office of all levels.

According to the document, prosecutors of the General, regional and local prosecutor's offices, as well as units of the military prosecutor's office, can submit an application by October 15, 2019 inclusively, to pass certification and transfer to work in the Office of the Prosecutor General, regional or district prosecutor's office.

Attestation will be conducted by staffing committees in three stages. The first two stages will assess the knowledge and ability to apply the law, as well as overall aptitude, through automated anonymous testing.

The last step is to check the candidate’s professional competence and integrity at the interview. Candidates will also perform a situational task.

Each stage will be held in the personal presence of the prosecutor.
