The law on changes in the work of the judiciary entered into force

On November 4, 2019, President of Ukraine Volodymyr Zelenskyi signed the Law of Ukraine «On Amending the Law «On the Judicial System and the Status of Judges» and some laws of Ukraine regarding the activities of the judiciary» (draft No. 1008), despite numerous calls to veto the legislative act.

On November 7, 2019 the law entered into force, causing a number of significant changes in the Ukrainian justice system.

First of all, the powers of the High Qualification Commission of Judges of Ukraine’s current composition were terminated (on this occasion, members of the Commission addressed the judges with a letter).

The new composition of the HQCJ will be selected at a competition held by the High Council of Justice. Its composition will decrease from 16 to 12 members.

A citizen of Ukraine who speaks the state language, has a law degree and has been working in the field of law for at least 15 years, applies to the legal profession and is politically neutral, can apply for a position of a member of the High Qualification Commission of Judges of Ukraine.

The competitive commission will include three members of the Council of Judges of Ukraine and three experts proposed by international organizations.

Previously, the Commission included eight judges and two representatives each from the State Judicial Administration, the Ukrainian Parliament Commissioner for Human Rights, the Bar and higher legal educational institutions, but lawyers and scholars will no longer be included in the new composition.

The new composition of the High Qualification Commission of Judges should be formed within 90 days.

New members of the Commission within two months should halve the number of judges of the Supreme Court: from 200 to 100. The selection should be based on the criteria of professional competence, ethics and virtue.

The last day of the work of a judge of the Supreme Court who has not passed the selection procedure is the date specified in the decision of the High Council of Justice. These judges can be transferred to the relevant courts of appeal, taking into account the rating formed by the results of the election.

The Ukrainian National Bar Association (UNBA) notes that a decrease in the number of judges of the Supreme Court will negatively affect the right of citizens to access the court.

It should be added that the Monitoring Committee of the Parliamentary Assembly of the Council of Europe has requested the opinion of the Venice Commission on the draft law. The document is to be evaluated by the Venice Commission in December this year.

The UNBA warns that ignoring the conclusions of the Venice Commission could result in a reduction in European investment in projects related to European integration.

Law on authorized economic operators entered into force

On November 7, 2019, the Law of Ukraine «On Amending the Customs Code of Ukraine Regarding Certain Issues of Functioning of Authorized Economic Operators», adopted by the Verkhovna Rada on October 2, 2019, entered into force.

The law was developed in fulfillment of Ukraine’s obligations under the Association Agreement with the European Union and the Trade Facilitation Agreement with World Trade Organization.

The law introduces in Ukrainian legislation the mechanism of the authorized economic operators institution similar to that which operates in the EU, with the prospect of further mutual recognition.

Today, the programs of an authorized economic operator have already been implemented in 83 countries of the world, another 19 countries are at the stage of their active implementation. Over the past year, the number of concluded international agreements on mutual recognition of AEO has significantly increased – from 57 to 78.

The program of authorized economic operators provides the following benefits for enterprises:

- acceleration of customs procedures (reduced risk; simplified declaration procedure);

- improving the service of providing customs services (the possibility of goods arriving immediately at the company’s warehouse, a warning about the physical inspection of the cargo);

- saving costs (reducing delays at the border, reducing the cost of services of customs terminals);

- predictability of doing business (transparent and pre-understood procedures for customs clearance, improving security and improving communication between partners in the supply chain).

The State Judicial Administration approves a new concept of Unified Judicial Information and Telecommunication System

The State Judicial Administration of Ukraine has approved the new Concept of the Unified Judicial Information and Telecommunication System (UJITS).

The document sets out which subsystems will be open to the public and which will only be accessible to justice officials.

Citizens will gain access to the following subsystems:

- electronic account of external user of UJITS;

- Unified state register of court decisions (open subsystem with anonymized data);

- Unified state register of executive documents (access of authorized users to executive documents through the electronic office of an external user of UJITS);

- subsystem «Judicial dossier» (open subsystem);

- subsystem «Electronic court» (exchange of documents of court cases with participants through the electronic user account of an external user);

- subsystem «Judicial practice»;

- web portal of the judiciary of Ukraine;

- subsystem «Open data sets»;

- subsystem «Automated interaction with other automated systems».

Justice workers will gain access to the following subsystems:

- electronic account of internal user of UJITS;

- the unified state register of court decisions (secure subsystem where information is stored in its entirety, including restricted information);

- the unified state register of executive documents (secure subsystem where information is stored in its entirety, including restricted information);

- subsystem «Referee’s dossier» (secure subsystem where information is stored in its entirety, including restricted information);

- subsystem «Electronic archive»;

- subsystem of analytics, statistics, planning, reporting;

- subsystem «Judicial practice»;

- subsystem of automated distribution of cases;

- a subsystem for the exchange of electronic documents;

- access control subsystem and information security;

- electronic document management subsystem;

- subsystem of personnel management and financial and economic activities;

- subsystem of secure video conferencing;

- Judicial Contact Center and UJITS Technical Support Service.

Military police will be created in Ukraine

President of Ukraine Volodymyr Zelenskyi considers it necessary to create the Military Police and to develop by the end of the year the concept of a unified register of veterans.

President stated this during a meeting with the leadership of the Verkhovna Rada and the government.

In particular, Minister of Defense Andrii Zahorodniuk must introduce a new integrated system of leadership and control of the defense forces by December 31. It must comply with NATO standards. In addition, a modern effective law enforcement body, the Military Police, should be created in the structure of the Ministry of Defense.

The President also stated that by the end of the year, the Ministry of Veterans’ Affairs and Temporarily Occupied Territories should create a concept of a unified registry of veterans and develop a project task for the E-Veteran platform.

In addition, the Head of State instructed the Minister of Internal Affairs Arsen Avakov to improve the procedures for issuing driver’s licenses, as well as to simplify accreditation procedures for institutions providing driver training by the end of the year.
