Legal news in Ukraine: competition to Office of Prosecutor General has started, a new decision of Constitutional Court, selection of legal aid lawyers, project «I have the right» is closed, law on Entrepreneurship Development Fund has entered into force

The reception of documents for the prosecutor positions in the Prosecutor General’s Office has started

On January 20, 2020 the reception of documents for the posts of prosecutors in the Office of the Attorney General has started.

100 posts are vacant.

The competition procedure is similar to the certification of prosecutors and consists of three stages – tests for knowledge of the law and general abilities and an interview with a practical task.

Documents from applicants will be accepted until February 2, 2020 inclusive.

Based on the results of the competition, a ranking of successful candidates will be compiled, then training and internship will be held.

The competition will be open to individuals with a law degree and five years of law experience.

In addition, during February and March of 2020 an open competition will be held for the posts of the Specialized Anti-Corruption Prosecutor's Office’s prosecutors.

There are 11 vacancies for prosecutors in the departments of procedural leadership, prosecution and representation in court.

On January 24, 2020, the first meeting of the selection committee was held.

The Constitutional Court ruled on constitutional complaint

The Constitutional Court of Ukraine ruled in the case on a constitutional complaint, in which the plaintiff challenged the provisions according to which information on requests for case files considered by the Constitutional Court is not provided.

The Constitutional Court recognized the provisions of the second sentence of the fourth part of Article 42 of the Law of Ukraine «On the Constitutional Court of Ukraine» as constitutional.

The Court emphasized that the right of a person to access information guaranteed by Article 34 of the Constitution of Ukraine is not absolute and may be subject to restrictions. Such restrictions should be exceptions provided for by law, pursue one or more legitimate goals and be necessary in a democratic society.

In case of right restriction to access information, the legislator is obliged to introduce such legal regulation that will make it possible to optimally achieve the legitimate goal with minimal interference with the exercise of this right and not violate the essential content of such a right.

The issue of access to public information in the Constitutional Court of Ukraine is governed by Article 42 of the Law. According to the law, the Court is the manager of both open public information and restricted information.

The complaint contains the personal data of the person (confidential information about the person) and, in fact, is the result of his intellectual activity. In this regard, the texts of constitutional complaints are not public information and are not published on the official website of the Constitutional Court.

Thus, the contested provisions of the Law are aimed at protecting information with limited access.

In addition, the contested legislative restriction is not censorship in the field of constitutional proceedings, since it is temporary and ends at the same time as the end of the proceedings.

Selection of lawyers for legal aid has begun

On January 20, a competition began to select attorneys who will provide free secondary legal aid.

To participate in the competition, lawyers must register before February 23, 2020.

The Legal Aid Coordination Center will check the submitted documents and information about the lawyer in the Unified Register of Lawyers of Ukraine.

If the application is filed incorrectly, the lawyer will be able to re-register.

Until March 9, lawyers must take the online course «Introduction to Free Legal Aid Systems» and complete test tasks that will be evaluated automatically.

In March, candidates will undergo individual interviews with the competition committee. Lawyers are evaluated according to the criteria of motivation to provide free legal assistance, sociability, emotional balance, and the like.

During the interview with the competition commissions, lawyers must present the originals of the passport and certificate of the right to practice law.

The competition committee will also verify disciplinary action against lawyers.

Lawyers who will pass the contest will provide legal assistance on an ongoing basis or temporarily under the contract.

The Cabinet of Ministers has closed the legal education project «I have the right»

On January 15, 2020, the Cabinet of Ministers of Ukraine by its decree canceled the decisions related to the legal education project «I have the right».

The previous government launched the project in 2017 and in July 2019 continued it for another three years.

Thus, the government canceled orders of the Cabinet of Ministers of Ukraine dated September 13, 2017 No. 638 «On the implementation of the legal education project «I have the right» in 2017 – 2019»; dated December 20, 2017 No. 1012 «On approval of the Strategy informing citizens about the rights guaranteed by the Constitution and laws of Ukraine for the period up to 2019» and dated July 17, 2019 No. 552 «On the implementation of the legal education project «I have the right» in 2020 – 2022».

It should be noted that the project «I have a right» explained how to protect the rights of Ukrainians in various spheres of life – from elections to adoption of children.

Oleksii Honcharuk’s government did not explain why the project was closed.

The Law on Entrepreneurship Development Fund came into force

On January 23, 2020, the Law of Ukraine «On Amendments to the Law of Ukraine «On the State Budget of Ukraine for 2020» on Ensuring the Functioning of the Entrepreneurship Development Fund» came into force.

The changes include the allocation of $ 2 billion to launch a loan program at 5, 7 and 9 percent to support micro and small businesses.

The program will allow small and medium-sized entrepreneurs to open their own business and create thousands of jobs already in 2020.

The Enterprise Development Fund will provide support in the form of interest rate compensation of up to 5, 7 and 9 percent per annum on loans in UAH. The percentage depends on the size and type of business.

Also, support for entrepreneurs will be provided in the form of partial guarantees on loans, if the small and medium business lacks collateral.
