Chairman of the Council of Judges of Ukraine has resigned

On July 5, 2019 Chairman of the Council of Judges of Ukraine Oleg Tkachuk read out a statement of resignation.

He announced his intention to take part in the competition for the post of judge of the Constitutional Court.

«In order to avoid questions about the presence of a conflict of interests, since it is the Council of Judges of Ukraine that is responsible for holding a competition for the position of Constitutional Court’s judge. I resign as Chairman of the Council of Judges and stop participating in Council meetings until the end of the competition», said Oleg Tkachuk.

The Council of Judges of Ukraine satisfied the application of Oleg Tkachuk.

Oleg Tkachuk earlier declared pressure on judges by the Presidential Administration of Ukraine. He noted that such a situation «does not accord with the principles of democracy, indicates a real threat to the judiciary and can undermine its authority as an impartial arbiter in social, political, economic disputes».

On June 24, the Council of Judges of Ukraine began to receive documents from the candidates for the post of judge of the Constitutional Court of Ukraine.

The Constitutional Court of Ukraine consists of eighteen judges – the six are appointed by the President, the Verkhovna Rada and the Congress of Judges of Ukraine. A candidate for the position of a judge of the Constitutional Court is elected on a competitive basis.

It should be noted that the powers of the three judges of the Constitutional Court will expire in September.

The competition for 505 vacations of judges in local general courts is announced

On July 2, the High Qualification Commission of Judges of Ukraine announced a competition for the 505 vacant positions of judges in local general courts.

Candidates must send documents to the address: 03109, city. Kiev, st. General Shapoval, 9 until July 12, 2019.

Documents may not be submitted in person or by email.

For participation in the competition the candidate submits:

1) a written application for participation in the competition (the candidate may apply to only 5 judges)

2) a copy of the passport of a citizen of Ukraine;

3) the questionnaire of the candidate for the position of judge;

4) a copy of the work record, service record (if available) or other documents confirming the professional experience in the field of law;

5) CD with scanned copies of documents and information about the candidate.

The living wage and the minimum pension have been increased in Ukraine

The living wage for able-bodied persons has grown by 86 UAH - from 1921 UAH to 2007 UAH.

For the main social and demographic groups of the population, the living wage is:

for children up to 6 years: 1699 UAH (previously 1626 UAH)

for children from 6 to 18 years: 2118 UAH (previously 2027 UAH)

for persons who have lost the ability to work: 1564 UAH (previously 1497 UAH).

In addition, the size of social assistance, that depends on the living wage for persons who have lost their ability to work, has been increased.

Recalculation will be subject to, in particular:

minimum and maximum pensions (1564 UAH and 15 640 UAH);

the additional payment for overtime, provided for in Article 28 of the Law of Ukraine «On Compulsory State Pension Insurance» (except for pensioners who work (carry out activities related to the receipt of income, which is the basis for the calculation of the single contribution to the compulsory state social insurance));

a supplement to a pension for special merits in accordance with the Law of Ukraine «On pensions for special merits to Ukraine», increase in accordance with the Laws of Ukraine «On the Status of War Veterans, Guarantees of Their Social Protection» and «On Victims of Nazi Persecution»;

monthly state targeted assistance to war invalids and combatants;

the minimum pension payment to persons with disabilities in respect of whom a causal relationship has been established between the disability and the Chernobyl disaster and disabled people from the participants in the liquidation of the consequences of the Chernobyl accident;

state social assistance for the care of war invalids.

The Constitutional Court will consider the case of judges' salaries

On July 3, the Constitutional Court of Ukraine began consideration of a case on the constitutional complaint about the constitutionality of the provisions of the first paragraph of paragraph 22, paragraph 23 of Section XII «Final and transitional provisions» of the Law of Ukraine «On the Judicial System and Status of Judges» of June 2, 2016 No. 1402-VIII.

The complainant believes that these provisions do not meet the requirements of parts one, two, Article 8, parts one and two of Article 24, paragraphs 1, 5 and 6 of Article 126 of the Constitution of Ukraine.

The author of the petition argues that the remuneration of judges (different size of judges 'remuneration) who did not pass the qualification assessment and judges who passed such an assessment or were appointed for the post based on the results of the competition, which was conducted after the Law came into force, but perform the same official duties, is discriminatory.

The fact that judges are differentiated according to that grounds casts doubt on the professionalism of the person holding such a position, which violates the constitutional guarantees of the independence of judges and their equality before the law.

The Constitutional Court has started the consideration of the case on the suffrage of judges

The Constitutional Court of Ukraine has commenced consideration of the case on the constitutionality of the provisions of the second sentence of part four of Article 54, part nine of Article 56 of the Law of Ukraine «On the Judiciary and Status of Judges» of June 2, 2016, No. 1402-VIII.

These provisions stipulate that a judge who is in office can not be a candidate for elective positions in state bodies (other than judiciary) and local self-government bodies, as well as to participate in election campaigning (second sentence of part four of article 54).

Part ninth of Article 56 of the Law provides that a judge can not receive state awards, except for awards for his manifestation of personal courage and heroism in conditions associated with the risk to life.

The provisions of the second sentence of the fourth part of Article 54 of the Law «constitute an arbitrary and expansive interpretation of the requirements of the second part of Article 127 of the Constitution of Ukraine, by which the judges are in fact deprived of passive suffrage».

The provisions of the ninth part of Article 56 of the Law enshrines discrimination of judges in relation to other representatives of the authorities in Ukraine on the possibility of obtaining state awards.

According to the authors of the petition, the provisions of the second sentence of part four of Article 54 of the Law do not comply with Articles 8, 22, 24, 38, 64, 127 of the Constitution of Ukraine, and the provisions of Article ninth of Article 56 of the Law contradict Articles 1, 8, 9, 21, 22 , 23, 24, 92 of the Fundamental Law of Ukraine.
