Leaders of the High Anti-Corruption Court were elected

On May 7, 2019 a meeting of the High Anti-Corruption Court’s judges elected the Chairman of the court.

Olena Tanasevych became the chairman of the court. She was chosen by secret ballot - 23 judges voted for her.

The second candidate, Judge Olga Salandyak, was supported by 10 judges. The vote for the Chairman of the Court took place in several stages. Chairman of the court was chosen at the third try.

Olena Tanasevych is professional judge. She was first appointed by the Decree of the President of Ukraine on May 18, 2012 as a judge of the Pechenizhskyy District Court of the Kharkiv Region for a term of five years.

On March 6, 2019, the High Qualification Commission of Judges of Ukraine recommended the appointment of Tanasevych to the position of the Anti-Corruption Court’s judge. On March 18, 2019, the High Council of Justice made a submission to the President of Ukraine on the appointment of Tanasevych as a judge of this court.

Yevgeniy Kruk was elected as Vice-Chairman of the Court, and Andriy Bitsyuk, Volodymyr Voronkov, Vira Mykhaylenko, Natalya Movchan, Oksana Oliynyk, and Olga Salandyak were elected as investigators judges.

In addition, judges also determined when the Court will begin to work – on Thursday, September 5, 2019.

During this time, the premises allocated for the Supreme Anti-Corruption Court will be repaired. Now the court is temporarily located in the Pecherskyy district court of the city of Kiev on Khreshchatyk and on Gaytsana street. Is should be noted, that according to the law the investigative and appellate chambers of the Court cannot work in the same building.

The President of Ukraine appointed 38 judges for 39 vacant positions in court: 11 judges of the Appeals Chamber and 27 judges of the High Anti-Corruption Court.

Presidential Decree on the appointment of Supreme Court’s judges was published

President of Ukraine Petro Poroshenko signed Decree No. 195/2019 and appointed judges of the Supreme Court.

The President appointed 75 judges in accordance with part five of Article 126, part one of Article 128 of the Constitution of Ukraine and Articles 80, 81 of the Law of Ukraine «On the Judiciary and the Status of Judges».

25 judges have been appointed to the Cassation Administrative Court; 15 judges – to the Cassation Economic Court; 22 judges – to the Cassation Civil Court and 13 judges – to the Cassation Criminal Court.

So from now on the Supreme Court will work practically in full force – 193 of 200 judges. The list of appointed judges can be downloaded at this link.

Let’s recall that the second competition to the Supreme Court began on August 2, 2018.

566 candidates were admitted to the competition. 235 people got to the final stage, of which 46 candidates did not confirm their ability to administer justice in the Supreme Court.

On March 7, High Qualification Commission of Judges of Ukraine recommended the appointment of 78 winners. As a result, The High Council of Justice submitted a submission to the President of Ukraine on the appointment of 75 applicants to the Supreme Court.

International Tribunal heard the case of captured Ukrainian sailors

On May 10, the International Tribunal for the Law of the Sea heard a lawsuit by Ukraine against Russia on the fact of the illegal seizure of three Ukrainian military ships and their crews.

Jin-Hyun Paik, chairman of the tribunal, announced that the decision on the case will be announced on May 25.

At the end of the meeting, Deputy Minister for Foreign Affairs of Ukraine and Agent of Ukraine Olena Zerkal stated Ukraine's demand: the Russian Federation must immediately release the vessels and return them to Ukraine, suspend the criminal proceedings against 24 detained Ukrainian servicemen and refrain from violating the new proceedings against them; release detained military personnel and allow them to return to Ukraine.

In addition, four lawyers attended the hearing: Marney Cheek, Jonathan Himblet, Jean-Marc Tuvenin and Alfred Soons.

Russia refused to participate in the hearings.

According to the lawsuit of Ukraine dated April 16, 25, 2018, «The Russian Federation took control and detained three Ukrainian naval vessels - Berdyansk, Nikopol and Yany Kapu - and 24 servicemen; at the time of their arrest, Ukrainian ships were in the Black Sea, were going to their port in Odessa.

In the request for interim measures, Ukraine claims that the Russian Federation has «violated the sovereign immunity of warships, auxiliary vessels of the navy, their passengers and crew members in accordance with articles 32, 58, 95 and 96 of the Convention and international customary law», the tribunal states.

On April 1, 2019, Ukraine sent a notification to the Russian Federation and submitted the dispute to the arbitration proceedings provided for in Annex VII to the Convention.

Prior to the establishment of the arbitral tribunal, any party of the dispute may apply to the International Tribunal for the Law of the Sea, with a request for interim measures to preserve the relevant rights of the parties of the dispute or to prevent serious damage to the marine environment. This is provided by article 290, paragraph 5, of the Convention.

The Tribunal may order interim measures if it considers that the arbitral tribunal to be established has jurisdiction and that this requires the urgency of the situation.

The Cabinet of Ministers appointed the Chairman of the State Tax Service

The Cabinet of Ministers of Ukraine appointed Sergey Verlanov as the Chairman of the State Tax Service.

Verlanov became the winner of the competition, that began on March 20, 2019.

The State Fiscal Service reported that the next steps should be the registration of the Tax Service as a legal entity, the transfer of the State Fiscal Service’s employees to the State Tax Service (at least 30% of workers) and the government's decision to start the work of the new structure.
