The Verkhovna Rada approved the amendments to the law on the prosecutor’s office

The Verkhovna Rada approved the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor’s Office».

According to the law, after the attestation of prosecutors the existing system of prosecuting authorities will be replaced by the following: Office of the Attorney General, Regional Prosecutor’s Offices, District Prosecutor’s Offices.

The post of Attorney General can now be applied for by a person with a law degree and a minimum of five years of experience in the field of law. Previously, candidates could alternatively have had law enforcement experience.

Prosecutors of all levels can be transferred to the position of prosecutor in the Attorney General's Office, regional prosecutor's offices, district prosecutor’s offices only if they successfully pass their certification.

Attestation of prosecutors is conducted by staffing committees that evaluate the professional competence of prosecutors, their professional ethics and integrity.

Attestation of prosecutors involves the examination in the form of anonymous written testing and interviewing.

Prosecutors who fail certification will be dismissed.

The certification will not apply to prosecutors of the Specialized Anti-Corruption Prosecutor’s Office.

The law provides for the liquidation of military prosecutors, provides the Prosecutor General with the right to liquidate and reorganize district and regional prosecutors. According to the changes, the Prosecutor General of Ukraine will have two first deputies.

The law reduces the number of employees of the prosecution authorities by one third: from 15,000 to 10,000.

Temporarily, until September 1, 2021, the powers of the qualification and disciplinary commission of prosecutors are suspended.

Persons who have not been prosecutors but who have a law degree and experience in the field of law will be able to participate in the competition for prosecutors.

The Verkhovna Rada adopted the Law on Overload of Power

The Verkhovna Rada adopted the Law of Ukraine «On Amending Certain Laws of Ukraine Concerning the Overload of Power».

The legislative act introduces amendments, in particular, to the laws «On Central Executive Bodies», «On the Cabinet of Ministers of Ukraine» and «On Public Service».

One of the main innovations of the law is the introduction of a contract form of civil service. The head of the relevant civil service will conclude and terminate public service contracts.

Special requirements for persons applying for public service positions will be prescribed in contracts.

The law also eliminates ranking for officials. Instead, civil service positions in public bodies are divided into categories and subcategories, depending on the order of appointment, nature and scope of authority, the content of the work and its impact on the final decision, the degree of official responsibility, the required level of qualification and professional competencies of civil servants.

The salary of a public servant will consist only of: 1) an official salary; 2) allowances for length of service and 3) bonuses.

The deputies approved the Law on Jurisdiction of the High Anti-Corruption Court as a whole

On September 18, 2019, the Verkhovna Rada of Ukraine adopted the Law of Ukraine «On Amending the Law of Ukraine» On the High Anti-Corruption Court (on the beginning of the court)» in the second reading and in general.

The approved bill takes into account 11 amendments of people’s deputies.

According to the law, the Anti-Corruption Court will only consider corruption cases, the investigation of which began from the day the Сourt was launched and the cases, the investigation of which has begun and is now being investigated by the NABU.

Also, to the court are transferred all criminal proceedings, the investigation of which was completed by anti-corruption prosecutors and the trial of which was not completed before the start of the Anti-Сorruption Court’s work.

We should add that the Anti-Corruption Court began work on September 5, 2019.

The creation of the Anti-Court Court was one of the main requirements of the International Monetary Fund. The Public Council of International Experts, led by Sir Anthony Hooper of Great Britain, took part in the selection of judges.

The Verkhovna Rada withdrew an article on fictitious entrepreneurship from the Criminal Code of Ukraine

On September 18, 2019, the Verkhovna Rada approved the Law «On Amendments to the Criminal Code of Ukraine and the Criminal Procedure Code of Ukraine on Reducing Business Pressure».

The law excludes from the Criminal Code of Ukraine article 205 «Fictitious Entrepreneurship», which provides for criminal liability for the creation or acquisition of business entities (legal entities) in order to cover illegal activities or engage in activities in respect of which there is a ban.

Thus, the adoption of this law will make it impossible to use Article 205 of the Criminal Code of Ukraine as a tool for abuse in bringing persons to justice. The supervisory authorities will not be able to use pre-trial investigation materials to resolve tax disputes in court.

The Verkhovna Rada presented the draft state budget for 2020

On September 18, 2019, the Minister of Finance Oksana Markarova presented in the Verkhovna Rada a draft state budget for 2020.

Budget revenues are 1,079.5 billion UAH and expenditures are 1 170 billion UAH.

The subsistence minimum per person since January 1, 2020 is 2 027 UAH. From July 1, the subsistence minimum will increase to 2 118 UAH, and from December 1 – to 2 189 UAH.

At the same time, the project states that the government plans to approximate the subsistence level to 4251 UAH in 2020.

In 2020 the minimum wage will be 4723 UAH.

For the State Criminal Enforcement Service will be allocated 7 581,3 million UAH, for the State Bureau of Investigation - 1 902,7 million UAH, for the prosecutor's office - 7 670,7 million UAH, for the National Anti-Corruption Bureau - 1 038,1 million UAH, and for the judicial power is provided 17 902,3 million UAH.

The main spending units are: the Constitutional Court of Ukraine, the Supreme Council of Justice, the Supreme Court, the High Anti-Corruption Court, the High Court on Intellectual Property, and the State Judicial Administration of Ukraine.

The president has appointed 50 judges to local courts

President of Ukraine Volodymyr Zelenskyi has appointed 50 judges to local courts.

41 judges were appointed to the local general courts. In particular, 9 judges will work in the courts of Dnipropetrovsk region, four judges will be appointed to Vinnytsia region.

The three judges were appointed to the courts of Zhytomyr, Kyiv and Kharkiv, oblasts, and the two – to the regions of Donetsk, Zaporozhia, Rivne, Kherson, Khmelnytskyi and Cherkasy.

The one judge is sent to the Kirovohrad, Lviv, Poltava, Ternopil oblasts, as well as to Mykolaiv, Odessa and Chernihiv.

Also the one judge is appointed to the Commercial Court of Donetsk region and eight judges to posts in the local administrative courts of Dnipro, Donetsk, Zhytomyr, Kharkiv, Khmelnitskyi, Cherkasy, Chernihiv and Kyiv.
