Legal order and paramilitary formation

The legal order is one of the most complicated and overwhelming categories that characterize the right of law and its existence. A lawyer novice and ordinary citizen-observer on legal order can speak only in the context of real relationships in society and to a greater extent in public places, bringing the understanding of legal order into public order, which, of course, cannot fully disclose all aspects of the legal order. But let's not deepen into the delicate matter of the theory of law, but this is not important at the moment.

Recent years of modern Ukrainian history have shown the presence in the society of seemingly at first glance of informal institutions, which, with the use of force, as a rule, physical force, provided and continue to provide for the resolution of conflict situations around important local or regional issues that were not resolved by the authorities or the same solution did not suit the representatives of these informal institutes. Such social institutions combine a clear organization and discipline, a semi-military form, and necessarily the ability to apply force that actually solves a conflict situation in favor of an interested party where informal power institutions operate. From the point of view of the law, the activities of such institutions cannot be recognized as legitimate and only in the absence of the law of the activities of such institutions is possible. Such paramilitary formations or paramilitary groups are a substitute for the institutions of the state, which must decide in accordance with the current legislation based on the provisions of the Constitution, all controversial, including conflict situations, establishing in accordance with the provisions of law the real legal order in society.

The lack of law and the lack of authorities lead to the formation, existence of paramilitary formations, whatever name they would have and who would not be in their composition. In the future, such formations compete with the law enforcement agencies, acting in the direction of establishing legal order at their discretion. But will it be the legal order? Will this not be the vision of the legal order at the discretion of everyone who represents such paramilitary formations? Does not it lead to deepening the crisis of law and power? The questions are clear and the answers are clear: the paramilitary formations with their so-called paramilitary legal order are a manifestation of irresponsible attitude to protecting the law of the state and, unfortunately, evidence of the weakness of state authority, which loses credibility and suffers humiliation precisely because of the existence of the mentioned formations. We can hear good words about involving the public in the protection of public order, we can once again take a sedative from politicians who are interested in such formations and, incidentally, produce their existence, but the essence of it will not change - the state authority, which deliberately speculates on existence competitive force detachments, which is incapable of ensuring legal order, requires significant reforms to strengthen the legitimacy and trust of society. Paraphrasing the famous saying if state legal order enforcement bodies are not able to protect a person and society, such protection will introduce other paramilitary forces by establishing their paramilitary quasi legal order. An example of recent court and court events surrounding a mayor of one of the largest cities showed all the decaying activity of paramilitary formations, and at the same time testified again that one so-called informal power organization necessarily got to confront another power organization, whose confrontation is also ruled out in its true sense, the activities of the authorities, including the judiciary, on the restoration of violated legal order, and the protection of law, are being undermined.

The paramilitary’s quasi legal order is the first serious evidence of the destruction of authority of its constitutional deformation, which cannot be left out of the attention and response of civil society and its institutions. An exception to this rule is if the paramilitary formations have conditional informality and if such education is not left beyond the control of the state. Nevertheless, in this case a serious mistake is assumed, since the legal order cannot have substitutes. Paramilitary formations dissolve both the idea of law and the appointment of the state, and this leads to more serious consequences, which can be the dismantling of the insolvent to the legitimacy of authority and social chaos instead of the legal order.
